STANDARD TERMS & CONDITIONS OF MOTORCYCLE RENTAL

HR RIDE PORTUGAL, S.A., head office at Avenida Severiano Falcão, 7/7A, 2689-522 Prior Velho, registered at the Commercial Registry Office of Loures under the number 515184144 (hereinafter referred to as Rental Company), rents the identified vehicle (motorcycle) through this rental agreement and under the following terms and conditions.

This document includes all the terms and conditions of the rental agreement executed between the Rental Company and the Renter, which should read it carefully. If the Renter does not understand any of the provisions of this document, the Renter must require pertinent clarifications from the representative of the Rental Company. With the signature of this document the Renter acknowledges that he did not request any clarification that has not been provided.

BOOKING CONDITIONS

Driving License: Both the renter and any additional drivers must provide a valid, unexpired driver’s license for the class of motorcycle rented (including any necessary endorsements) in their name. If your driver’s license is not issued in Europe, then you must also bring an international driving permit. Drivers need to be at least 21 years of age and have at least three years of experience riding motorcycles with the same rating as the Motorcycle. These conditions may change according to the motorcycle identified.
Identification: A passport or personal ID card is required
Credit Card: The renter must have a credit card (VISA or MASTERCARD) in his or her own name when picking up the motorcycle (American Express, Dinners, prepaid credit card, charge card or cash cards will not be accepted). At the time of rental, we will request an authorization (hold) on your credit card for the excess of the estimated rental charges plus Non-Waivable Excess (NWE) deposit/ guarantee. The card must have enough available funds to cover the hold for the duration of the rental). We will also charge all additional charges, local fees, optional equipment that you rent or anything else that you purchase at the rental counter to the credit card at the time of rental.
Reservation confirmation: The renter must present this Reservation Confirmation when picking up the motorcycle. Refer to the Terms and Conditions for more information.
Roadside Assistance: You have available road assistant 24h in the original country. Please ask at the desk for details.
Payment Information: The booking of the motorcycle requires the payment by the Renter of monetary amount as a reserve deposit corresponding to 20% of the rental. The Rental Company reserves the right to make the availability of the motorcycle conditional to the effective demonstration by the Renter of the payment of the reservation deposit. The rental must be made within a maximum of 12 months from the date of reservation. Please note that ´Total Amount to pay on pick up’ will be charged in local currency. Any other currency displayed is for information purposes only.
Extensions, Amendments, Cancellations and No-Shows: If you wish to extend or modify your rental after the pick-up date and time specified on this Reservation Confirmation, you must contact Hertz Ride directly at hertzride@hertzride.com whether you have actually picked up the motorcycle or not. Extension or modification of your rental before the rental starts (i.e., before the pick-up date and time specified on this Reservation Confirmation) may only be arranged by sending Hertz Ride an e-mail at (hertzride@hertzride.com). Please note that modifying your reservation may result in a change in your rental rate or additional or higher charges based on changes to the length of the rental or to the motorcycle type rented. If your scheduled pick-up time is less than 48 hours away and you wish to modify your booking, please call us at (+351 210 413 334). If the rental price changes due to modifications (e.g., pick-up or drop-off location, motorcycle group or length of rental), you will be charged at the current published price, which may be different or higher from the initial price booked. In addition, if the original reservation was subject to a promotional or discounted fee, you may no longer qualify for that fee, and the modified reservation may be at a substantially higher rate. You will not receive a credit or refund if you return the rented motorcycle earlier than the scheduled due-in date and time.

Modifications: Modifications to reservations can only be made by email to our Contact Center through hertzride@hertzride.com. The estimated total charges will be recalculated based on availability and prices at the time the modification is made. The total charges may be greater or lesser than the price originally booked. This policy applies to changes made to: Drop off location, pick up date and time, Drop off time and date, Motorcycle group, All other additional products.
Cancelations: If you wish to cancel your reservation, you must inform Hertz Ride in writing to hertzride@hertzride.com before your rental is due to start - cancellation fees may apply. The payment made at the time of reservation is refundable only if the reservation is cancelled at least 30 days before the scheduled pick-up date.
No Shows: Hertz Ride reserves the right to refuse the motorcycle to any user who fails to arrive on time (including a 30-minute “grace period”), fails to provide all the necessary documentation and/or information, fails to provide a credit card with enough available funds for the deposit; or if the driver show signs of being under the influence of alcohol, drugs or any other substance affecting his perception or reactions or otherwise appears unfit to operate the motorcycle. In such cases, unless the rental has been cancelled in advance, the renter will be considered a “no show” and will not be entitled to a refund. The prices are based on the pick-up and drop-off times and dates that the user arranges before the rental starts. If the user picks the motorcycle up any later or brings the motorcycle back any earlier, the user will not receive a refund for the unused hours or days.

Extras: All extras extra, optional equipment and services, including GPS, Helmets, Communications system, and low seats, are subject to local availability and availability cannot be guaranteed. (Ex: GPS, Helmets, Intercommunication System and Low seats). All extra optional equipment is provided “As-Is,” and you are responsible for ensuring that you understand how to use and/or install any of the optional equipment.
Optional Special Damage Coverage: At the counter, costumer can opt to add additional coverage regarding damage responsibility. Please ask our Customer Sale Representative at the location about conditions to add these coverages.

NATURE OF THE AGREEMENT

This Agreement is an agreement for the rental of the Motorcycle. You may not transfer or assign your rights in this Agreement or your right to use the Motorcycle.
The Renter understands that we are not an affiliate, agent or franchisee of The Hertz Corporation (or any of its affiliates) (collectively “Hertz”). We are an independently owned and operated company with a limited license from Hertz to use the name, “Hertz Ride” in connection with a motorcycle rental business in Europe. The Renter understands and agrees that Hertz is not a party to this Agreement and has no obligations to him. The Renter agrees that will not make any demands or pursue any claims against Hertz.
The Renter understands that original Equipment Manufacturers (OEMs) are not directly involved in and responsible for the organisation and management of the Rentals, so no misunderstanding shall occur when we mention the wording “OEM Rental Partner” or the official Rental Partner of a specific OEM.

CONDITION OF THE MOTORCYCLE – DELIVERY AND RETURN

The Renter acknowledges that has received the Motorcycle in good working and clean condition, including both tires, and agrees to return it in the same condition (with its keys, equipment, tools and/or accessories) at the location and on the date specified in the Rental Agreement.

The Renter is prohibited to modify any technical features of the Motorcycle or its keys, equipment, tires, tools and/or accessories or to make any aesthetic change to the Motorcycle, including the application of stickers, vinyls or camera brackets without its removal. If the Renter breaches this provision, he will be responsible for all costs that the Rental Company incur to restore the Motorcycle to its original status, as well as for the damage suffered by stopping the Motorcycle while it is being repaired.

If the Motorcycle is used in breach of the provisions of the Agreement, the Rental Company may, at any time and without prior notice, terminate the Agreement and take back possession of the Motorcycle, at the Renter's expense.

If the Motorcycle is not returned 48 hours after the return date and time stipulated in the Rental Agreement, the police will be notified of its disappearance.

RENTAL PERIOD

The minimum Rental Period is one day. A “day” is a 24-hour day beginning on the date and time noted on the Rental Agreement. If the Renter returns the Motorcycle more than 29 minutes after the scheduled return time, the Rental Company reserves the right to charge the Renter for an additional rental day at the applicable daily rate as shown on the Price List. If the Renter wishes to extend the scheduled Rental Period, the Renter must request for the Rental Company express written authorisation and pay for the estimated additional charges before the scheduled return time. Under no circumstances may the deposit be used as form of payment in case of extension of the Rental Agreement.

RENTAL RATE AND DEPOSIT

The daily rental rate, as well as the deposit amount, are determined by the Price List in effect when the Renter signs this Agreement. The standard payment method is credit card or debit card. The Renter pays the total amount of the rental with the signature of this Agreement. The Renter allows the Rental Company to block the amount of the deposit on his credit card at the time of the rental (see the Price List at the counter), as well as the total estimated charges. The Rental Company may use the blocked amount to pay all charges. The Rental Company authorises the release of the blocked value at the end of the rental if it is not necessary to pay any additional charges. The rules of the issuer of the payment card of the Renter will be applied to credit any amount the Renter´s account, which may not be immediately available by the Renter´s card issuer.

CHARGES

All charges referred to in this Agreement are calculated in accordance with the Rental´s Company current Price List and based on the use of the Motorcycle by the Renter. The Renter agrees to pay at the Rental´s Company request or, being the case to reimburse, the following amounts:

Daily Rental Rate for the Rental Period, including an additional mileage fee if you exceed the daily mileage indicated on the Rental Agreement;
A mileage charge based if the odometer is tampered with or disconnected;
Fees for optional products, equipment, and services that were acquired;
Fuel and a refuelling fee if the Motorcycle is returned with less fuel than when it was rented;
Expenses that the Rental Company incur to locate and to recover the Motorcycle if the Renter fails to return it or if the Rental Company repossess it under the terms of this Agreement;
All costs incurred by the Rental Company to enforce or defend its rights under this Agreement;
A cleaning fee, as indicated at the Price List, to clean the Motorcycle if returned substantially less clean than it was rented or if stickers, vinyls or camera mounts are applied without removing them;
A lost key fee if the Renter loses the keys of the Motorcycle;
Other surcharges if the Renter returns the Motorcycle to a location other than the location where the Motorcycle was rented;
Towing and all other charges incurred by the Rental Company arising from the improper use of the Motorcycle by the Renter;
Cost of replacing damaged or lost parts and materials used in Motorcycle accessories or optional equipment, such as helmets, intercom systems, low seats or navigation systems;
The costs of issuing the Motorcycle documentation, in case of loss or misplacement.

All complaints or objections regarding the aforementioned charges must be communicated to the Rental Company, within a maximum period of 30 days after receipt of the invoices, after which they will not be considered accepted.

The Renter authorises that the rental charges, and any others that are directly or indirectly related to the rental of the Motorcycle, even after its return and in accordance with the Agreement be debited from the credit card account or another account indicated for the it.

RESPONSIBILITY FOR DAMAGE OR LOSS OF THE MOTORCYCLE

In the event of any loss or damage, theft or robbery of the Motorcycle or parts of it while on rental, Renter shall pay the Rental Company the amount of all costs and losses including, without limitation, repair costs, depreciation, loss of renting revenues, towing and Motorcycle collection expenses, the amount established in the current Price List as the maximum non-waivable excess (Price List at the counter) or if higher, the amount of the costs, losses or damages effectively incurred
The Renter limits his responsibility under the terms set out below. In any event it is established that said limitation of responsibility is expressly excluded (i) in case of breach by the Renter or by any unauthorised driver, with intend or gross negligence, of the terms of this agreement; (ii) if the damages result, in any case, of the behaviour of an unauthorised driver; (iii) in case of dangerous driving of the Motorcycle or driving the Motorcycle in violation of any applicable regulations and, especially, in case of noncompliance with the Road Code, particularly when the damages are result of negligence from the Renter, speeding or driving under the influence of alcohol or narcotics.
The Collision Damage Coverage Option (hereinafter CDW) and the Theft Protection Option (hereinafter TP) are included in the daily rental rate. In the CDW, liability for loss or damage to the motorcycle is equal to 30% of the value of the motorcycle. In the TP, liability for theft or robbery is limited to the amount of the deposit required at the beginning of the rental agreement.
The Renter can acquire Super CDW (hereinafter SCDW) or the service of Super CDW VIP (hereinafter SCDW VIP). Should the Renter acquire the SCDW reduces his responsibility for loss or damages of the Motorcycle until a maximum of 50% of the deposit required at the beginning of the rental agreement (price list at the counter). Should the Renter acquire the SCDW VIP reduces his responsibility for loss or damages of the Motorcycle until a maximum of 75% of the deposit required at the beginning of the rental agreement (price list at the counter).

CDW, SCDW and SCDW VIP do not apply to optional equipment that we rent for use on the Motorcycle. CDW, SCDW and SCDW VIP also do not cover lost keys.

RENTER’S RESPONSIBILITY

Rental Company shall not be held responsible for any loss or damage suffered by the Renter except in the event of gross negligence, intend, or in case of death or bodily injury in case the responsibility cannot be legally excluded.

DRIVERS

Only drivers who meet the following requirements are allowed to rent motorcycles:

a driving license valid in the country of permanent residence that qualifies the person to use a Motorcycle of the same category as the rented Motorcycle;
at least 21 years of age and at least three years of experience driving motorcycles with the same classification of the same category as the rented Motorcycle;

CONDITIONS OF USE

The Renter must take care of the Motorcycle, ensuring that the handlebars are locked and blocked and parked in a safe place when not in use, apply adequate fuel, as well as connect and use the safety devices displayed on the vehicle.

The Renter must not use or allow the use of the vehicle in the following circumstances:

Transport of passengers or cargo for remuneration;
To propel or tow any vehicle, trailer or other object;
Transport cargo for any illegal purpose;
To transport more than the maximum number of passengers specified by the manufacturer or the applicable law, or transport passengers who are traveling in a position other than the seat designed for the use of passengers;
Carry excessive cargo in relation to the weight/quantity/volume specified by the manufacturer;
Transport corrosive or dangerous materials;
On unpaved roads;
Participate in any race, rally, test or other type of competition, as well as participate in any type of “track days”;
To transport an animal;
Outside the European Union, without prior authorisation from the Rental Company;
Transfer the Motorcycle to any island without prior written authorisation;
When the driver is under the influence of alcoholic beverages, drugs or any other substance that reduces his perception or reaction capacity;
In violation of any traffic rules or, in general, for illicit purposes;
For sublease;
The Renter does not meet the minimum requirements stipulated in our current tariff with regard to age and valid driving license;
By any other person who is not the authorised driver or who, if so, does not meet the minimum requirements demanded by the Lessor in terms of age and a valid driving license. In such cases, the Lessee is also responsible for using the Motorcycle and will have to indemnify the Lessor under the terms of the agreement;

If the Renter violates any of the previous paragraphs, the Rental Company reserves the right to charge the Renter the total amount of damage caused to the vehicle, regardless of the additional coverage purchased.

ACCIDENTS OR BREAKDOWNS

In case of accident, loss, damage or theft, the Renter undertakes cumulatively to:

Call the police to the site of the accident.
Report the event to the Rental Company within a maximum period of 24 hours.
Fill out the Agreed Statement of Facts on Motorway Vehicle Accident which is included in the documents of the vehicle, as well as to complete and sign the accident or theft report form at the nearest Rental Company Location.
To cooperate with Rental Company and its insurers in any subsequent investigation or legal proceedings. Similarly, in the event of a breakdown, the Rental Company must be immediately informed, applying the above rules, with the necessary adjustments.

Should the Renter fail to comply with the procedures mentioned above, regardless of additional coverage purchased, the Rental Company reserves the right to charge to the Renter the total amount of damages caused to the vehicle. The Rental Company is under no obligation to provide the Renter with a replacement motorcycle if the rented motorcycle is lost, damaged or stolen.

VIOLATION OF TRAFFIC RULES

During the rental period, the Renter is entirely responsible for all fines and/or penalties resulting from the violation of any traffic, parking, and toll regulations, as well as for any inconvenience or responsibility resulting therefrom.

Should the Renter incur in any penalties and/or fines during the rental period, notwithstanding the amount to be paid for said penalties and/or fines, the Rental Company will also charge an administrative fee. The Rental Company shall provide the Renter, upon demand, a copy of any notification received regarding traffic, parking, and/or toll violations.

“VIA VERDE” TOLL MANAGEMENT SERVICE

The Rental Company provides the Renter with a Via Verde identifier owned by the Rental Company, which allows to determine the value of the toll fees in order to collect them under the electronic toll services provided in the road infrastructures duly equipped for this purpose, being the Renter solely responsible for the full payment of the value of the toll passages, during the period of validity of the rental agreement.
For the use of the Via Verde service, the Renter will be charged an amount in accordance with what is defined in the legislation that regulates this regime.
According to the provisions displayed by the Law Decree nr 84-C/2022 of December 9th, the subscription to the Via Verde service is automatic.
For payment purposes, the Renter must provide a valid credit card, ensuring a sufficient balance in the corresponding bank account to meet the payments due, the debits that may occur subsequently to the use of the road infrastructure mentioned above, accepting that the debits will be carried out after the closing of the rental agreement and according to the dates that are made available by Via Verde Portugal, as long as the use of the road infrastructure has occurred during the period of the rental agreement.
The Renter is also responsible for the correct operation and for the preservation, in perfect conditions, of the Via Verde identifier, not being allowed to remove the referred equipment from the place where it is installed and must report any anomaly to the Rental Company.
Should the Rental Company verify any non-compliance with any of the conditions referred to in the previous numbers, namely the abusive use of the identifier, the Renter is liable for all resulting damages and respective penalties, such as fines, and must reimburse the Rental Company for them, as well as to pay the penalties that might be applied (administrative fee).
Renter’s liability for each Via Verde identifier only ends when it is returned to the Rental Company. If the Via Verde identifier is not returned at the end of the Rental Agreement, Renter is required to pay the cost to the Rental Company, as well as all the costs and fines that may arise from its absence.

PERSONAL BELONGINGS

Rental Company is not responsible for the loss or material damage caused to personal belongings left in the Motorcycle, either during the rental period or thereafter.

DISPUTE RESOLUTION & ARBITRATION

TELEMATICS NOTICE

The Motorcycle may be equipped with global positioning satellite (GPS) technology or another telematics system, and/or an event data recorder (EDR). You acknowledge and authorise as per point “17. Personal Information” and based on your personal consent that the use of this Motorcycle may be remotely monitored by us or on behalf of us through such systems to the extent permitted by law.

This remote monitoring may include collection of Motorcycle data, such as: location, odometer, oil life, fuel level, tire pressure, battery state of charge, diagnostic trouble codes, and other elements we may deem necessary. To the extent permitted by law, we may disable the Motorcycle when we deem necessary, including if you breach this Agreement. These systems may use cellular communications, and you should have no expectation of privacy related to your use of this Motorcycle. You agree to inform all drivers and passengers of the Motorcycle of the terms of this section, and that you have authorised release of information collected by GPS or other telematics system or EDR.

The Rental Company is not responsible for the operability of any telematics navigational or other system included with the Motorcycle to the extent permitted by law.

The motorcycle may be equipped with an “infotainment” system that allows Renter to connect their mobile devices. If you choose to do so, please be aware that the motorcycle can automatically load the address book, store your incoming, outgoing or missed phone calls and other information from your device. The Renter must follow the steps shown on the motorcycle's display system to delete this information and the device from the motorcycle's memory. The Rental Company is not responsible for ensuring the privacy of such information and cannot guarantee that other persons not authorised by the Rental Company have access to this information after returning the motorcycle.

PERSONAL INFORMATION

Upon signing the Agreement, the Renter must provide their personal data and the ones of the other driver(s) of the Motorcycle, for the purposes of identification, expressly authorising the Rental Company to process the data electronically.
According to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), the Rental Company informs that:

The entity responsible for processing the personal data provided in the agreement is HR Ride Portugal, S.A., head office in Avenida Severiano Falcão 7-7A, 2689-522 Prior Velho;
The main purpose of personal data processing is the conclusion and performance of this agreement, pursuant to Article 6 (1) (b) from the GDPR;
Personal data may be transmitted to third parties for the purpose of fulfilling legal requirements to which the Rental Company is subject, pursuant to Article 6 (1) (c) of the GDPR, in particular to judicial authorities, police, tax authorities and customs and any other public authority as required by law;
Personal data may be processed for other purposes, to which the Renter has given the Rental Company express consent;
The Rental Company will keep the personal data processed for the period of time necessary for the provision of services, billing and compliance with legal obligations.

The data subject has the right to, at any moment, access their personal data, as well as, within the agreement and GDPR terms, to rectify them and object their processing, to decide in regard of automated processing, to withdraw consent, request erasure of personal data and exercise the rights provided in applicable law (except when the data is necessary for the performance of the agreement and therefore, mandatory to provide, as well as for the compliance of legal obligations the Rental Company is subject).
If the Renter withdraw his/her consent, it does not affect the lawfulness of processing carried out until that moment.
The data subject has the right to be notified, in accordance with the GDPR, in the event of a personal data breach which may result in a risk to their rights and freedoms and may submit a claim to the competent authority(ies).
Personal data may be transmitted to third parties which provide services to the Rental Company, whenever these services require the transfer of information contained in the rental agreements.

Spanien

STANDARD TERMS & CONDITIONS OF MOTORCYCLE RENTAL

HR - Comercio de Automoveis e Motociclos, S.L., with N.I.F B14349567 (hereinafter referred to as the Rental Company) rents the vehicle (motorbike) identified in the rental contract on the following terms and conditions.

If the user picks the motorcycle up any later or brings the motorcycle back any earlier, the user will not receive a refund for the unused hours or days.

Extras: All extras extra, optional equipment and services, including GPS, Helmets, Communications system, and low seats, are subject to local availability and availability cannot be guaranteed. (Ex: GPS, Helmets, Intercommunication System and Low seats). All extra optional equipment is provided “As-Is,” and you are responsible for ensuring that you understand how to use and/or install any of the optional equipment.
Optional Special Damage Coverage: At the counter, costumer can opt to add additional coverage regarding damage responsibility. Please ask our Customer Sale Representative at the location about conditions to add these coverages.

NATURE OF THE AGREEMENT

This Agreement is an agreement for the rental of the Motorcycle. You may not transfer or assign your rights in this Agreement or your right to use the Motorcycle.
The Renter understands that we are not an affiliate, agent or franchisee of The Hertz Corporation (or any of its affiliates) (collectively “Hertz”). We are an independently owned and operated company with a limited license from Hertz to use the name, “Hertz Ride” in connection with a motorcycle rental business in Europe. The Renter understands and agrees that Hertz is not a party to this Agreement and has no obligations to him. The Renter agrees that will not make any demands or pursue any claims against Hertz.
The Renter understands that original Equipment Manufacturers (OEMs) are not directly involved in and responsible for the organization and management of the Rentals, so no misunderstanding shall occur when we mention the wording “OEM Rental Partner” or the official Rental Partner of a specific OEM.

CONDITION OF THE MOTORCYCLE – DELIVERY AND RETURN

If the Motorcycle is not returned 48 hours after the return date and time stipulated in the Rental Agreement, the police will be notified of its disappearance.

RENTAL PERIOD

The minimum Rental Period is one day. A “day” is a 24-hour day beginning on the date and time noted on the Rental Agreement. If the Renter returns the Motorcycle more than 29 minutes after the scheduled return time, the Rental Company reserves the right to charge the Renter for an additional rental day at the applicable daily rate as shown on the Price List. If the Renter wishes to extend the scheduled Rental Period, the Renter must request for the Rental Company express written authorization and pay for the estimated additional charges before the scheduled return time. Under no circumstances may the deposit be used as form of payment in case of extension of the Rental Agreement.

RENTAL RATE AND DEPOSIT

The daily rental rate, as well as the deposit amount, are determined by the Price List in effect when the Renter signs this Agreement. The standard payment method is credit card or debit card. The Renter pays the total amount of the rental with the signature of this Agreement. The Renter allows the Rental Company to block the amount of the deposit on his credit card at the time of the rental (see the Price List at the counter), as well as the total estimated charges. The Rental Company may use the blocked amount to pay all charges. The Rental Company authorizes the release of the blocked value at the end of the rental if it is not necessary to pay any additional charges. The rules of the issuer of the payment card of the Renter will be applied to credit any amount the Renter´s account, which may not be immediately available by the Renter´s card issuer.

CHARGES

Daily Rental Rate for the Rental Period, including an additional mileage fee if you exceed the daily mileage indicated on the Rental Agreement;
A mileage charge based if the odometer is tampered with or disconnected;
Fees for optional products, equipment, and services that were acquired;
Fuel and a refuelling fee if the Motorcycle is returned with less fuel than when it was rented;
Expenses that the Rental Company incur to locate and to recover the Motorcycle if the Renter fails to return it or if the Rental Company repossess it under the terms of this Agreement;
All costs incurred by the Rental Company to enforce or defend its rights under this Agreement;
A cleaning fee, as indicated at the Price List, to clean the Motorcycle if returned substantially less clean than it was rented or if stickers, vinyls or camera mounts are applied without removing them;
A lost key fee if the Renter loses the keys of the Motorcycle;
Other surcharges if the Renter returns the Motorcycle to a location other than the location where the Motorcycle was rented;
Towing and all other charges incurred by the Rental Company arising from the improper use of the Motorcycle by the Renter;
Cost of replacing damaged or lost parts and materials used in Motorcycle accessories or optional equipment, such as helmets, intercom systems, low seats or navigation systems;
The costs of issuing the Motorcycle documentation, in case of loss or misplacement.

The Renter authorizes that the rental charges, and any others that are directly or indirectly related to the rental of the Motorcycle, even after its return and in accordance with the Agreement be debited from the credit card account or another account indicated for the it.

RESPONSIBILITY FOR DAMAGE OR LOSS OF THE MOTORCYCLE

In the event of any loss or damage, theft or robbery of the Motorcycle or parts of it while on rental, Renter shall pay the Rental Company the amount of all costs and losses including, without limitation, repair costs, depreciation, loss of renting revenues, towing and Motorcycle collection expenses, the amount established in the current Price List as the maximum non-waivable excess (Price List at the counter) or if higher, the amount of the costs, losses or damages effectively incurred
The Renter limits his responsibility under the terms set out below. In any event it is established that said limitation of responsibility is expressly excluded (i) in case of breach by the Renter or by any unauthorized driver, with intend or gross negligence, of the terms of this agreement; (ii) if the damages result, in any case, of the behaviour of an unauthorized driver; (iii) in case of dangerous driving of the Motorcycle or driving the Motorcycle in violation of any applicable regulations and, especially, in case of noncompliance with the Road Code, particularly when the damages are result of negligence from the Renter, speeding or driving under the influence of alcohol or narcotics.
The Collision Damage Coverage Option (hereinafter CDW) and the Theft Protection Option (hereinafter TP) are included in the daily rental rate. In the CDW, liability for loss or damage to the motorcycle is equal to 30% of the value of the motorcycle. In the TP, liability for theft or robbery is limited to the amount of the deposit required at the beginning of the rental agreement.
The Renter can acquire Super CDW (hereinafter SCDW) or the service of Super CDW VIP (hereinafter SCDW VIP). Should the Renter acquire the SCDW reduces his responsibility for loss or damages of the Motorcycle until a maximum of 50% of the deposit required at the beginning of the rental agreement (price list at the counter). Should the Renter acquire the SCDW VIP reduces his responsibility for loss or damages of the Motorcycle until a maximum of 75% of the deposit required at the beginning of the rental agreement (price list at the counter).

CDW, SCDW and SCDW VIP do not apply to optional equipment that we rent for use on the Motorcycle. CDW, SCDW and SCDW VIP also do not cover lost keys.

RENTER’S RESPONSIBILITY

DRIVERS

Only drivers who meet the following requirements are allowed to rent motorcycles:

a driving license valid in the country of permanent residence that qualifies the person to use a Motorcycle of the same category as the rented Motorcycle, as long as the license is issued by a country of the European Union and the European Economic Area (Iceland, Liechtenstein and Norway); or a country license that is written in Spanish or accompanied by an official translation thereof; or country licenses issued in accordance with Annex 9 of the Geneva Convention, or Annex 6 of the Vienna Convention, or that differ from these models only in the adoption or suppression of non-essential headings (these licenses will be valid when the maximum period of six months has not elapsed since normal residence in Spain has been acquired; the current driving license is valid; and the holder has the required age in Spain to obtain an equivalent Spanish license. In all other cases, an International Driving Permit must be presented together with the Renter's Driving Permit and Passport;
at least 21 years of age and at least three years of experience driving motorcycles with the same classification of the same category as the rented Motorcycle.

CONDITIONS OF USE

The Renter must not use or allow the use of the vehicle in the following circumstances:

Transport of passengers or cargo for remuneration;
To propel or tow any vehicle, trailer or other object;
Transport cargo for any illegal purpose;
To transport more than the maximum number of passengers specified by the manufacturer or the applicable law, or transport passengers who are traveling in a position other than the seat designed for the use of passengers;
Carry excessive cargo in relation to the weight/quantity/volume specified by the manufacturer;
Transport corrosive or dangerous materials;
On unpaved roads;
Participate in any race, rally, test or other type of competition, as well as participate in any type of “track days”;
To transport an animal;
Outside the European Union, without prior authorization from the Rental Company;
Transfer the Motorcycle to any island without prior written authorization;
When the driver is under the influence of alcoholic beverages, drugs or any other substance that reduces his perception or reaction capacity;
In violation of any traffic rules or, in general, for illicit purposes;
For sublease;
The Renter does not meet the minimum requirements stipulated in our current tariff with regard to age and valid driving license;
By any other person who is not the authorized driver or who, if so, does not meet the minimum requirements demanded by the Lessor in terms of age and a valid driving license. In such cases, the Lessee is also responsible for using the Motorcycle and will have to indemnify the Lessor under the terms of the agreement;
Carrying as passengers children under 12 years of age. Children over 7 years of age may be passengers as long as the renter of the motorcycle is their father, mother or guardian.

ACCIDENTS OR BREAKDOWNS

In case of accident, loss, damage or theft, the Renter undertakes cumulatively to:

Call the police to the site of the accident.
Report the event to the Rental Company within a maximum period of 24 hours.
Fill out the Agreed Statement of Facts on Motorway Vehicle Accident which is included in the documents of the vehicle, as well as to complete and sign the accident or theft report form at the nearest Rental Company Location.
To cooperate with Rental Company and its insurers in any subsequent investigation or legal proceedings. Similarly, in the event of a breakdown, the Rental Company must be immediately informed, applying the above rules, with the necessary adjustments.

VIOLATION OF TRAFFIC RULES

PERSONAL BELONGINGS

Rental Company is not responsible for the loss or material damage caused to personal belongings left in the Motorcycle, either during the rental period or thereafter.

DISPUTE RESOLUTION & ARBITRATION

This agreement is subject to Portuguese law. In case of dispute, the consumer may appeal to a Consumer Alternative Dispute Resolution Entity or to a court. The parties consider that the courts of Lisbon shall have jurisdiction, with express waiver of any other, in accordance with the provision of Regulation EC 44/2001, which provides that there is an agreement conferring jurisdiction to the courts of one of the Member States of the contracting parties.

TELEMATICS NOTICE

The Motorcycle may be equipped with global positioning satellite (GPS) technology or another telematics system, and/or an event data recorder (EDR). You acknowledge and authorize as per point “16. Personal Information” and based on your personal consent that the use of this Motorcycle may be remotely monitored by us or on behalf of us through such systems to the extent permitted by law.

This remote monitoring may include collection of Motorcycle data, such as: location, odometer, oil life, fuel level, tire pressure, battery state of charge, diagnostic trouble codes, and other elements we may deem necessary. To the extent permitted by law, we may disable the Motorcycle when we deem necessary, including if you breach this Agreement. These systems may use cellular communications, and you should have no expectation of privacy related to your use of this Motorcycle. You agree to inform all drivers and passengers of the Motorcycle of the terms of this section, and that you have authorized release of information collected by GPS or other telematics system or EDR.

The Rental Company is not responsible for the operability of any telematics navigational or other system included with the Motorcycle to the extent permitted by law.

The motorcycle may be equipped with an “infotainment” system that allows Renter to connect their mobile devices. If you choose to do so, please be aware that the motorcycle can automatically load the address book, store your incoming, outgoing or missed phone calls and other information from your device. The Renter must follow the steps shown on the motorcycle's display system to delete this information and the device from the motorcycle's memory. The Rental Company is not responsible for ensuring the privacy of such information and cannot guarantee that other persons not authorized by the Rental Company have access to this information after returning the motorcycle.

PERSONAL INFORMATION

Upon signing the Agreement, the Renter must provide their personal data and the ones of the other driver(s) of the Motorcycle, for the purposes of identification, expressly authorizing the Rental Company to process the data electronically.
According to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), the Rental Company informs that:

The entity responsible for processing the personal data provided in the agreement is HR Ride Portugal, SA, head office in Avenida Severiano Falcão 7-7A, 2689-522 Prior Velho;
The main purpose of personal data processing is the conclusion and performance of this agreement, pursuant to Article 6 (1) (b) from the GDPR;
Personal data may be transmitted to third parties for the purpose of fulfilling legal requirements to which the Rental Company is subject, pursuant to Article 6 (1) (c) of the GDPR, in particular to judicial authorities, police, tax authorities and customs and any other public authority as required by law;
Personal data may be processed for other purposes, to which the Renter has given the Rental Company express consent;
The Rental Company will keep the personal data processed for the period of time necessary for the provision of services, billing and compliance with legal obligations.

The data subject has the right to, at any moment, access their personal data, as well as, within the agreement and GDPR terms, to rectify them and object their processing, to decide in regard of automated processing, to withdraw consent, request erasure of personal data and exercise the rights provided in applicable law (except when the data is necessary for the performance of the agreement and therefore, mandatory to provide, as well as for the compliance of legal obligations the Rental Company is subject).
If the Renter withdraw his/her consent, it does not affect the lawfulness of processing carried out until that moment.
The data subject has the right to be notified, in accordance with the GDPR, in the event of a personal data breach which may result in a risk to their rights and freedoms and may submit a claim to the competent authority(ies).
Personal data may be transmitted to third parties which provide services to the Rental Company, whenever these services require the transfer of information contained in the rental agreements.

HR France – Location des Véhicules et Mobilité, SARL., Hauptsitz in der 41 Boulevard Maître Maurice Slama 06200 Nice, France, registriert bei der RCS Nice unter der Nummer 820 227 999 (nachstehend „Vermieter“), vermietet das genannte Fahrzeug (Motorrad) im Rahmen dieses Mietvertrags, zu den dort geltenden spezifischen Bedingungen und nach Maßgabe der folgenden Allgemeinen Geschäftsbedingungen.

Dieses Dokument enthält alle Allgemeinen Geschäftsbedingungen des vom Vermieter und dem Mieter abgeschlossenen Mietvertrages, und der Mieter sollte ihn sorgfältig lesen. Wenn der Mieter eine der in diesem Dokument enthaltenen Bestimmungen nicht versteht, sollte er den unterstützenden Vertreter des Vermieters um die entsprechende Erklärung bitten.

DEFINITIONEN
1. „Zusätzliche obligatorische Gebühren" sind gesondert ausgewiesene Gebühren, die Sie für die Zeit, für die der Mietpreis gilt, für die Miete oder das Leasing des Motorrads zahlen müssen und die von einer staatlichen Stelle erhoben werden und die sich speziell auf den Betrieb eines Mietwagengeschäfts beziehen. Zusätzliche obligatorische Gebühren umfassen eine Kundeneinrichtungsgebühr, Flughafenkonzessionsgebühr, Gebühr für die Tourismuskommission oder andere staatlich verordnete Steuern oder Gebühren.
2. „Vertrag" bezeichnet alle Bedingungen in diesen Allgemeinen Geschäftsbedingungen, dem „Mietvertrag", dem „Fahrzeugzustandsbericht", der Rechnung, der Risikoübernahme und Freigabe („Freigabe") und allen anderen Zusätzen, die wir zum Zeitpunkt der Vermietung bereitstellen (und die Sie unterschreiben).
3. „Autorisierter Fahrer" bezeichnet einen Fahrer, der zur Nutzung des Motorrads berechtigt ist. Sofern nicht ausdrücklich durch geltendes Recht genehmigt, sind nur der Vermieter und ein zusätzlicher Fahrer, der von uns zum Zeitpunkt der Anmietung auf der ersten Seite Ihres Vertrags aufgeführt ist, berechtigt, das Motorrad zu fahren. Jeder autorisierte Fahrer muss: (i) einen gültigen Führerschein in dem Land meines ständigen Wohnsitzes besitzen, der diese Person berechtigt, ein Motorrad mit dieser Leistung zu fahren; (ii) mindestens 21 Jahre alt sein und (iii) mindestens drei Jahre Erfahrung mit dem Fahren von Motorrädern mit dieser Leistung zu haben. Diese Bedingungen können sich je nach dem genannten Motorrad ändern.
4. „Gebühren" sind die Abgaben und Gebühren, die im Rahmen dieses Vertrags anfallen. Alle in dieser Vereinbarung genannten Beträge sind in Euro zu zahlen.
5. „CDW" steht für Collision Damage Waiver.
6. „Verminderter Wert" bezeichnet die Differenz zwischen dem Marktwert des Motorrads vor einem Schaden oder Verlust und seinem Wert nach der Reparatur, der durch von uns oder von einem Dritten in unserem Namen durchgeführte Schätzung berechnet wurde.
7. Ein „Nutzungsausfall“ liegt vor, wenn wir aufgrund von Schäden am Motorrad oder seinem Verlust das Motorrad während des Mietzeitraums nicht weiter für unsere Zwecke nutzen können. Dies schließt die Nutzung für den Verleih, die Anzeige zum Verleih und/oder zum Verkauf, die Möglichkeit zur Nachrüstung oder zum Verkauf oder die Beförderung von Mitarbeitern ein.
8. „Motorrad" oder „Fahrzeug" bezeichnet das im Mietvertrag bezeichnete Motorrad und jedes Fahrzeug, durch das wir es ersetzen, sowie sämtliche Reifen, Werkzeuge, Zubehörteile, Ausstattung, Geräte, Schlüssel und Fahrzeugdokumente.
9. „Mietzeitraum" bezeichnet den Zeitraum zwischen dem Zeitpunkt, zu dem Sie das Motorrad übernehmen, und dem Zeitpunkt, zu dem das Motorrad entweder an uns zurückgegeben oder von uns abgeholt und von uns eingecheckt wird.
10. „Mietportfolio" ist ein Dokument, das Ihnen am Mietort zur Einsichtnahme zur Verfügung steht und detaillierte Informationen über die zur Miete angebotenen Motorräder sowie eine aktualisierte Preisliste der Tagesmieten und sonstigen Gebühren („Preisliste") enthält. Die Preisliste kann sich ändern.
11. „Kfz-Steuer" oder „Anteilige Kfz-Steuer" bezeichnet die anteiligen Kosten an der jährlichen Kfz-Steuer, basierend auf dem geschätzten Tagessatz je Fahrzeug an unserer gesamten jährlichen Kfz-Steuer sowie auf den Kosten für die Besitzurkunde/KFZ-Brief und die Zulassungskosten bzw. wie nach geltendem Recht anderweitig definiert.
12. „Sie", „Ihnen" und "Ihr/e" steht für die Person, die als "Mieter" identifiziert wurde, und für jeden autorisierten Fahrer.
13. „Wir", „uns/er/e/er" oder steht für HR France – Location des Véhicules et Mobilité, SARL. Das Unternehmen Hertz hat uns autorisiert, den Namen „Hertz Ride" zu verwenden.

BUCHUNGSBEDINGUNGEN

Führerschein: Sowohl der Mieter als auch alle weiteren Fahrer müssen einen gültigen, nicht abgelaufenen Führerschein für die Klasse des gemieteten Motorrads (einschließlich aller erforderlichen Vermerke) in ihrem Namen vorlegen. Wenn Ihr Führerschein in Europa nicht ausgestellt wurde, müssen Sie auch einen internationalen Führerschein vorlegen. Die Fahrer müssen mindestens 21 Jahre alt sein und mindestens drei Jahre Fahrpraxis mit einem Motorrad dieser Leistung haben. Diese Bedingungen können sich je nach dem genannten Motorrad ändern.
Identitätsfeststellung: Reisepass oder Personalausweis
Kreditkarte: Der Mieter muss bei der Abholung des Motorrads über eine Kreditkarte (VISA oder MASTERCARD) auf seinen eigenen Namen verfügen (American Express, Dinners, Prepaid-Kreditkarte, Charge Card oder Geldkarten werden nicht akzeptiert). Zum Zeitpunkt der Anmietung müssen Sie uns für Ihre Kreditkarte eine Genehmigung (Block) für die Überschreitung der geschätzten Mietkosten zuzüglich einer Kaution/Garantie für die Selbstbeteiligung erteilen. Die Karte muss über genügend Deckung für den Block während der Dauer der Mietzeit verfügen. Wir berechnen auch alle zusätzlichen Gebühren, lokalen Abgaben, optionale, von ihnen gemietete Ausstattung oder alles andere, was Sie am Mietschalter zum Zeitpunkt der Vermietung auf die Kreditkarte kaufen.
Reservierungsbestätigung: Der Vermieter muss diese Reservierungsbestätigung bei der Abholung des Motorrads vorlegen. Weitere Informationen finden Sie in den Allgemeinen Geschäftsbedingungen.
Pannenhilfe: Im Ausgangsland ist Pannenhilfe rund um die Uhr verfügbar. Bitte fragen Sie am Schalter nach Details.
Zahlungsinformationen: Bei der Reservierung des Motorrads ist vom Mieter ein Geldbetrag als Buchungsanzahlung in Höhe von 25 % der Miete zu zahlen. Der Vermieter behält sich das Recht vor, die Verfügbarkeit des Motorrads vom Nachweis der tatsächlichen Entrichtung der Buchungsanzahlung durch den Vermieter abhängig zu machen. Die Vermietung muss innerhalb von maximal 12 Monaten ab dem Datum der Buchung erfolgen. Bitte beachten Sie, dass der „Gesamte, bei der Abholung zu zahlende Betrag in der Landeswährung berechnet wird. Beträge in anderen Währungen werden nur zu Informationszwecken angegeben.
Erweiterungen, Änderungen, Stornierungen und No-Show: Wenn Sie Ihren Mietvertrag über den auf dieser Reservierungsbestätigung angegebenen Abholtermin hinaus verlängern oder ändern möchten, müssen Sie sich direkt an Hertz Ride unter hertzride@hertzride.com und reservations@hertzride.com wenden, egal ob Sie das Motorrad tatsächlich abgeholt haben oder nicht. Eine Verlängerung oder Änderung Ihres Mietvertrages vor Mietbeginn (d.h. vor dem in dieser Reservierungsbestätigung angegebenen Abholdatum und -uhrzeit) kann nur durch Zusendung einer E-Mail an Hertz Ride (hertzride@hertzride.com) vereinbart werden. Bitte beachten Sie, dass die Änderung Ihrer Reservierung zu einer Änderung Ihres Mietpreises oder zu zusätzlichen oder höheren Gebühren aufgrund von Änderungen der Mietdauer oder des gemieteten Motorradtyps führen kann. Wenn Ihre geplante Abholzeit weniger als 48 Stunden beträgt und Sie Ihre Buchung ändern möchten, rufen Sie uns bitte an (+351 210 413 334). Ändert sich der Mietpreis aufgrund von Änderungen (z.B. Abhol- oder Rückgabeort, Motorradgruppe oder Mietdauer), wird Ihnen der zu diesem Zeitpunkt jeweils aktuell veröffentlichte Preis berechnet, der vom ursprünglich gebuchten Preis abweichen oder höher sein kann. Wenn die ursprüngliche Reservierung außerdem mit einer Werbe- oder Rabattaktion verknüpft war, haben Sie möglicherweise keinen Anspruch mehr auf damit verbundene Preisminderung, so dass die geänderte Reservierung möglicherweise wesentlich teurer ist. Sie erhalten keine Gutschrift oder Rückerstattung, wenn Sie das gemietete Motorrad früher als geplant zurückgeben.
1. Änderungen: Änderungen der Reservierungen können nur per E-Mail an unser Contact Center unter reservations@hertzride.com vorgenommen werden. Die geschätzten Gesamtkosten werden auf der Grundlage der Verfügbarkeit und der Preise zum Zeitpunkt der Änderung neu berechnet. Die Gesamtkosten können höher oder niedriger als der ursprünglich gebuchte Preis sein. Diese Richtlinie gilt für Änderungen von: Rückgabeort, Abholdatum und -zeit, Rückgabezeit und -datum, Motorradgruppe, alle weiteren Zusatzprodukte
2. Stornierungen: Wenn Sie Ihre Reservierung stornieren möchten, müssen Sie Hertz Ride vor Mietbeginn schriftlich unter reservations@hertzride.com informieren - es können Stornogebühren anfallen. Die bei der Reservierung geleistete Zahlung wird nur zurückerstattet, wenn die Reservierung mindestens 30 Tage vor dem geplanten Abholtermin storniert wird.
3. No-Show: Hertz Ride behält sich das Recht vor, das Motorrad Benutzern zu verweigern, die nicht pünktlich ankommen (Gewährung einer 30-minütigen „Kulanzfrist "), nicht alle erforderlichen Unterlagen und/oder Informationen zur Verfügung stellen, keine Kreditkarte mit genügend Deckung für die Kaution zur Verfügung stellen oder wenn der Fahrer unter dem Einfluss von Alkohol, Drogen oder anderen Substanzen zu stehen scheint, die seine Wahrnehmung oder Reaktionen beeinträchtigen oder anderweitig als ungeeignet für den Betrieb des Motorrads erscheint. In solchen Fällen wird der Mieter, sofern der Mietvertrag nicht im Voraus storniert wurde, als „No-Show" erachtet und hat keinen Anspruch auf eine Rückerstattung. Die Preise basieren auf den Abhol- und Rückgabezeiten und -daten, die der Nutzer vor Mietbeginn vereinbart. Wenn der Benutzer das Motorrad später abholt oder das Motorrad früher zurückbringt, erhält er keine Rückerstattung für die nicht genutzten Stunden oder Tage.
Extras: Alle Extras, Zusatzausstattungen und Dienstleistungen, einschließlich GPS, Helme, Kommunikationssystem und niedrige Sitze, sind abhängig von der lokalen Verfügbarkeit, die nicht garantiert werden kann. (Bsp.: GPS, Helme, Intercom-System und niedrige Sitze) Alle zusätzlichen optionalen Ausstattungen werden „wie besehen" zur Verfügung gestellt, und Sie sind dafür verantwortlich, dass Ihnen die Verwendung und/oder Installation der optionalen Ausstattung bekannt ist
Optionale Deckung für besondere Schäden: Am Schalter kann der Kunde einen zusätzlichen Deckungsschutz für die Haftung bei Schäden abschließen. Bitte erkundigen Sie sich bei unserem Kundendienstmitarbeiter vor Ort nach den Bedingungen für die Hinzufügung dieser Leistungen.
1. SCDW – Mittlerer Deckungsschutz: Wenn Sie Super CDW erwerben, verzichten wir auf unser Recht, Sie für Kollisionsschäden haftbar zu machen - und zwar bis zu einem Höchstbetrag von 50 % des Marktwertes des Motorrads vor dem Schaden. Die Preise variieren zwischen 19 € und 25 € pro Tag, wobei ein Minimum von 5 Tagen pro Anmietung erforderlich ist.
2. VIP SCDW - Top-Deckungsschutz: Wenn Sie Super CDW VIP erwerben, verzichten wir auf unser Recht, Sie für Kollisionsschäden haftbar zu machen - und zwar bis zu einem Höchstbetrag von 75 % des Marktwertes des Motorrads vor dem Schaden. Die Preise variieren zwischen 35 € und 39 € pro Tag, wobei ein Minimum von 5 Tagen pro Anmietung erforderlich ist.

3. ART DES VERTRAGS

Sie verstehen, dass wir keine Tochtergesellschaft, Vertreter oder Franchisenehmer der Hertz Corporation (oder eines ihrer verbundenen Unternehmen) (zusammen „Hertz") sind.Wir sind ein unabhängig geführtes und betriebenes Unternehmen mit einer eingeschränkten Lizenz von Hertz zur Nutzung des Namens „Hertz Ride" im Zusammenhang mit Motorradverleih in Europa. Sie verstehen und erklären sich damit einverstanden, dass Hertz nicht Partei dieses Vertrages ist und Ihnen gegenüber keine Verpflichtungen hat.Darüber hinaus erklären Sie sich damit einverstanden, dass Sie keine Forderungen stellen oder Ansprüche gegen Hertz geltend machen werden.

ZUSTAND DES MOTORRADS - ÜBERGABE UND RÜCKGABE

Der Mieter bestätigt den Erhalt des Motorrads in einwandfreiem und sauberem Zustand, einschließlich beider Reifen, und verpflichtet sich, es im gleichen Zustand (mit seinen Schlüsseln, Ausstattungen, Werkzeugen und/oder Zubehörteilen) an dem im Mietvertrag angegebenen Ort und Datum an uns zurückzugeben.

Es ist untersagt, technische Merkmale des Motorrads oder seiner Schlüssel, Ausstattungen, Reifen, Werkzeuge und/oder Zubehörteile zu ändern oder eine ästhetische Änderung am Motorrad vorzunehmen. Wenn Sie gegen diese Bestimmung verstoßen, sind Sie für alle Kosten verantwortlich, die uns entstehen, um das Motorrad wieder in seinen ursprünglichen Zustand zu versetzen, sowie, soweit gesetzlich zulässig, für Folge- und Begleitschäden, die darauf zurückzuführen sind, dass wir das Motorrad während der Reparatur nicht benutzen können.

Im Rahmen der gesetzlichen Möglichkeiten: (a) können wir das Motorrad auf Ihre Kosten ohne es Ihnen vorher mitzuteilen zurücknehmen, wenn es zurückgelassen oder unter Verstoß gegen das Gesetz oder diesen Vertrag benutzt wird; (b) wenn das Motorrad 48 Stunden nach dem im Mietvertrag festgelegten Datum und Uhrzeit nicht zurückgegeben wird, gilt es als unterschlagen oder widerrechtlich angeeignet und kann der Polizei als gestohlen gemeldet werden. Die Nichtrückgabe des Motorrads kann eine Straftat darstellen, die im Rahmen des geltenden Rechts in vollem Umfang geahndet werden kann.

MIETDAUER

Die Mindestmietdauer beträgt einen Tag.Ein „Tag" ist ein 24-Stunden-Tag, der mit dem im Mietvertrag angegebenen Datum und der Uhrzeit beginnt. Wenn Sie das Motorrad mehr als 29 Minuten nach der geplanten Rückgabezeit zurückgeben, behalten wir uns das Recht vor, Ihnen einen zusätzlichen Miettag zum geltenden Tagessatz gemäß der Preisliste in Rechnung zu stellen.Wenn Sie die geplante Mietdauer verlängern möchten, müssen Sie unsere ausdrückliche schriftliche Genehmigung einholen und die geschätzten zusätzlichen Kosten vor der geplanten Rückgabezeit bezahlen.Die Kaution darf unter keinen Umständen als Zahlungsmittel im Falle einer Verlängerung des Mietvertrages verwendet werden.Wenn Sie das Motorrad nicht fristgerecht zurückgeben und es ohne unsere ausdrückliche Genehmigung weiter verwenden, können wir diese Vereinbarung kündigen, und Sie tragen die alleinige Verantwortung für die Zahlung von Bußgeldern oder Strafen, die gegen Sie, das Motorrad oder uns wegen des Fehlens aktualisierter Unterlagen verhängt werden.

MIETPREIS UND KAUTION

Der Tagesmietpreis sowie der Kautionsbetrag richten sich nach der Preisliste, die bei Abschluss dieses Vertrages gilt. Die Standardzahlungsmethode ist die Kreditkarte.Die Zahlung per Bar- oder Debitkarte bedarf unserer vorherigen Zustimmung und kann zusätzlichen Bedingungen unterliegen. Wenn wir die Barzahlung genehmigen, behalten wir uns das Recht vor, eine oder mehrere Kreditkarten des Mieters als Garantie zu verlangen. Sie erlauben uns, zum Zeitpunkt der Anmietung auf Ihrer Zahlungskarte (oder, wenn wir dies wünschen, eine Barhinterlegung) einen angemessenen Betrag zusätzlich zu den geschätzten Gesamtkosten zu reservieren. Sie erlauben uns, dass wir zum Zeitpunkt der Anmietung auf Ihre Zahlungskarte einen angemessenen Betrag zusätzlich zu den geschätzten Gesamtkosten reservieren (oder, sofern wir dies wählen, eine Barkaution verlangen). Wir können diese Reserve oder die Anzahlung verwenden, um alle Kosten zu bezahlen. Wir genehmigen die Freigabe einer überschüssigen Reserve (oder die Rückgabe einer Barkaution) nach Abschluss Ihrer Anmietung, wenn keine zusätzlichen Gebühren anfallen. Für die Gutschrift von Überschüssen auf Ihr Konto gelten die Regeln Ihres Kartenausstellers. Diese werden möglicherweise nicht sofort von Ihrem Kartenaussteller freigegeben.

KOSTEN

Alle Kosten basieren auf unserer aktuellen Preisliste, die Sie am Mietschalter einsehen können. Alle Gebühren sind in Euro zu zahlen. Sie zahlen uns bei oder vor dem Mietvertragsabschluss oder auf Wunsch alle Kosten, einschließlich:

Tagesmietpreis für die Mietperiode, einschließlich einer zusätzlichen Kilometergebühr, wenn Sie den auf der Vorderseite des Mietvertrages angegebenen Tageskilometerstand überschreiten;
Eine auf unseren Erfahrungswerten basierende Kilometerpauschale, wenn der Kilometerzähler manipuliert oder deaktiviert ist;
Gebühren für optionale Produkte, Ausstattungen und Dienstleistungen, die Sie gekauft haben;
Kraftstoff und eine Tankgebühr, wenn Sie das Motorrad mit weniger Kraftstoff als bei der Anmietung zurückgeben;
Zusätzliche obligatorische Gebühren;
Kosten, die uns bei der Lokalisierung und Bergung des Motorrads entstehen, wenn Sie es nicht zurückgeben oder wenn wir es gemäß den Bedingungen dieses Vertrags wieder in Besitz nehmen;
Alle Kosten, die uns durch die Durchsetzung oder Verteidigung unserer Rechte aus diesem Vertrag entstehen;
Eine angemessene Reinigungsgebühr gemäß Preisliste für die Reinigung des Motorrads, wenn es deutlich schmutziger zurückgegeben wird als bei der Vermietung;
Eine Gebühr für verlorene Schlüssel, wenn Sie die Schlüssel des Motorrads verlieren;
Einen Zuschlag, wenn Sie das Motorrad an einem anderen Ort als dem, an dem Sie das Motorrad gemietet haben, zurückgeben („Drop Fee") oder wenn Sie es nicht zu dem in Absatz 2 beschriebenen Datum und Uhrzeit zurückgeben („Late Fee");
Kosten für Abschleppen, Lagerung, Konfiszierung, Gerichtskosten, Strafen und alle anderen Kosten, die uns durch Ihre Nutzung des Motorrads entstehen;
Wiederbeschaffungskosten für verloren gegangene oder beschädigte Teile und Verbrauchsmaterialien, die für das Motorradzubehör oder Zusatzausrüstungen wie Helme, Intercom-Systeme, niedrigere Sitze oder Navigationssysteme verwendet werden; und
Die Kosten für die Beschaffung von Ersatzdokumenten zuzüglich einer angemessenen Verwaltungsgebühr, wenn Sie eines der Motorraddokumente, einschließlich der Fahrzeugzulassung, verlieren oder beschädigen.

Bei verspäteter Abholung oder vorzeitiger Rückgabe erfolgt keine Rückerstattung. Wenn Sie eine Kreditkarte oder eine andere Zahlungskarte verwenden, die von einer Bank oder einem Finanzinstitut ausgestellt wurde, wird jede Währungsumrechnung von der ausstellenden Bank durchgeführt. Alle Kosten unterliegen unserer abschließenden Prüfung. Werden nach Abschluss dieser Transaktion Fehler festgestellt, ermächtigen Sie uns, die Gebühren beim Kartenaussteller zu korrigieren. Sie müssen uns über alle Streitigkeiten im Zusammenhang mit den Kosten spätestens 30 Tage nach Erhalt der Rechnung informieren.

KEINE GARANTIEN; KEINE HAFTUNG

IM RAHMEN DER GESETZLICHEN MÖGLICHKEITEN: (A) ERKENNEN SIE AN, VERSTEHEN UND STIMMEN ZU, DASS WIR UND DIE HERSTELLER DER MOTORRÄDER UND IHRE VERBUNDENEN UNTERNEHMEN („HERSTELLER") WEDER AUSDRÜCKLICHE NOCH STILLSCHWEIGENDE ZUSICHERUNGEN ODER GARANTIEN IN BEZUG AUF DAS MOTORRAD GEBEN UND SICH VON SOLCHEN DISTANZIEREN, WIE ZUM BEISPIEL DESIGN, KAPAZITÄT, ZUSTAND, MARKTGÄNGIGKEIT ODER GEBRAUCHSTAUGLICHKEIT ODER EIGNUNG FÜR EINEN BESTIMMTEN ZWECK; UND (B) STIMMEN ZU, DASS WEDER WIR NOCH DIE HERSTELLER IHNEN GEGENÜBER FÜR VERLUSTE ODER ANDERE SCHÄDEN ODER AUSGABEN JEGLICHER ART HAFTBAR SIND, DIE DIREKT ODER INDIREKT DURCH DAS MOTORRAD, SEINEN GEBRAUCH, SEINEN BETRIEB ODER SEINE NICHTWARTUNG ODER DURCH EINE UNTERBRECHUNG DES BETRIEBS ODER DIE ENTGANGENE NUTZUNG DES MOTORRADS VERURSACHT WURDEN ODER DAMIT IN VERBINDUNG STEHEN.

HAFTUNG FÜR DIE BESCHÄDIGUNG ODER DEN VERLUST DES MOTORRADS

Sie müssen alle Unfälle oder Vorfälle wie Diebstahl oder Vandalismus uns und der Polizei melden, sobald Sie sie feststellen.

Sie sind verantwortlich für alle Schäden am Motorrad während der Mietzeit entstehen, unabhängig von der Schuld egal aus welchem Grund, einschließlich Schäden durch Kollision, Wetter, Vandalismus, Diebstahl, Straßenzustand und Naturereignisse. Sie haften für: a) alle physischen Schäden am Motorrad, die wie folgt ermittelt werden: (i) wenn wir feststellen, dass das Motorrad ein Totalschaden ist, den Marktwert des Motorrads, abzüglich der Bergung; (ii) wenn wir feststellen, dass das Motorrad reparierbar ist: (A) die Differenz zwischen dem Wert des Motorrads unmittelbar vor dem Schaden und dem Wert unmittelbar nach dem Schaden; oder (B) der angemessene geschätzte Einzelhandelswert oder die tatsächlichen Reparaturkosten zuzüglich des geschmälerten Wertes; (b) Nutzungsausfall, gemessen durch Multiplikation Ihres täglichen Mietpreises entweder mit der tatsächlichen oder geschätzten Anzahl von Tagen ab dem Zeitpunkt, an dem das Motorrad beschädigt wird, bis zu seinem Ersatz oder seiner Reparatur. Sie stimmen zu, dass dies in einem solchen Fall eine angemessene Schätzung der Nutzungsausfall-Schäden und keine Vertragsstrafe darstellt. Ein Nutzungsausfall ist unabhängig von der Nutzung des Fuhrparks zu zahlen; (c) eine angemessene Verwaltungsgebühr, die auf der Grundlage des Schadensschätzwertes wie folgt berechnet wird und deren Höhe Sie für angemessen halten: 0 € - 250 € Schaden = 50 € Gebühr; 251 € - 500 € Schaden = 75 € Gebühr; 501 € - 750 € Schaden = 100 € Gebühr; 751 € - 1500 € Schaden = 150 € Gebühr; 1501 € - 2500 € Schaden = 200 € Gebühr; über 2500 € Schaden = 250 € Gebühr (d) Abschlepp-, Lager- und Beschlagnahmekosten und andere angemessene Neben- und Folgeschäden; und (e) alle Kosten im Zusammenhang mit der Durchsetzung dieses Vertrags. Sie haften für Verlust oder Beschädigung des Motorrads infolge von Diebstahl oder Vandalismus im Zusammenhang mit dem Diebstahl; Sie müssen innerhalb von 24 Stunden nach Ihrer Kenntnisnahme eines Diebstahls eine Anzeige bei der Polizei erstatten und mit uns und der Polizei bei der Bereitstellung von Informationen über den Diebstahl kooperieren; sie sind für den Ersatz fehlender Ausstattung sowie Motorraddokumente und -schlüssel verantwortlich. Sie müssen jeden Motorradunfall oder einen Diebstahl und Vandalismus bei Bekanntwerden an uns und die Polizei melden.

ZUSÄTZLICHE DECKUNG (SCHADENSHAFTUNG)

Beim Kauf eines Deckungsschutzes für Kollisionsschäden (CDW) verzichten wir auf unser Recht, Sie finanziell für Kollisionsschäden am Motorrad verantwortlich zu machen.Wir bieten auch „Super CDW"- mit mittlerer Deckung und „Super CDW VIP"- mit Top-Deckung für das Motorrad an. Wenn Sie eine Super CDW kaufen, verzichten wir auf unser Recht, Sie für Kollisionsschäden finanziell verantwortlich zu machen - bis zu einem Höchstbetrag von 50 % des Marktwertes des Motorrads vor dem Schaden.Wenn Sie eine Super CDW VIP kaufen, verzichten wir auf unser Recht, Sie für Kollisionsschäden finanziell verantwortlich zu machen - bis zu einem Höchstbetrag von 75 % des Marktwertes des Motorrads vor dem Schaden. Super CDW und Super CDW VIP sind keine Versicherungen, sie sind optional und können die Deckung Ihrer eigenen Versicherungspolice oder Kreditkarte duplizieren. CDW, Super CDW und Super CDW VIP umfassen nicht die optionale Ausstattung, die wir Ihnen für die Verwendung mit dem Motorrad vermieten.CDW, Super CDW, Super CDW, Super CDW VIP umfassen auch keine verlorenen Schlüssel.Die Deckung Ihrer CDW, Super CDW oder Super CDW VIP erlischt und Sie sind haftbar für Verluste oder Schäden am Motorrad, (i) die aus einer verbotenen Nutzung (definiert in Paragraph 10 unten) resultieren oder (ii) wenn der Verlust oder Schaden vorsätzlich oder grob fahrlässig durch den Mieter, durch grobe Fahrlässigkeit eines zugelassenen Fahrers oder durch einen nicht autorisierten Fahrer verursacht wurde.

Bei Unfall, Verlust, Beschädigung oder Diebstahl sind die Polizei und das Mietunternehmen innerhalb von 24 Stunden zu informieren. Der Mieter muss den Schadensbericht zusammen mit der Dokumentation des Motorrads ausfüllen und an der nächstgelegenen Station des Mietunternehmens den Unfall, Verlust, Schaden oder Diebstahl melden, andernfalls gilt die Versicherung als null und nichtig. Der Mieter ist verpflichtet, mit dem Vermieter, der Polizei und der Versicherungsgesellschaft in allen nachfolgenden Ermittlungs- oder Gerichtsverfahren zusammenzuarbeiten und unverzüglich über alle Briefe, Vorladungen und Mitteilungen im Zusammenhang mit dem Unfall zu informieren und dem Mietunternehmen und der Versicherungsgesellschaft bei der Untersuchung und Verteidigung von Ansprüchen oder Gerichtsverfahren uneingeschränkte Mitarbeit zu gewähren.

Das Mietunternehmen ist auf keinen Fall verpflichtet, dem Mieter ein Ersatzmotorrad zur Verfügung zu stellen, wenn das gemietete Motorrad Gegenstand von Unfällen oder Verlust, Beschädigung oder Diebstahl ist.

NUTZUNGSBEDINGUNGEN UND VERBOTENE NUTZUNG
1. Nutzungsbedingungen während der Mietdauer:
  1. Sie müssen das Motorrad sicher parken.Wenn das Motorrad beispielsweise nicht in Gebrauch ist, müssen Sie das Lenkrad verriegeln und blockieren und alle Dokumente des Motorrads aufbewahren.
  2. Sie stimmen zu, nur Kraftstoff zu verwenden, der den Spezifikationen des Herstellers entspricht, und regelmäßig Öl- und Wasserstände, Reifendruck und alle anderen grundlegenden Systeme des Motorrads zu überwachen.
  3. Nur die Person oder Personen, die vom Mietunternehmen als autorisierte Fahrer definiert und akzeptiert wurden, sind berechtigt, das Motorrad zu fahren.
  4. Sie erklären sich damit einverstanden, alle für Ihre Nutzung des Motorrads geltenden Gesetze einzuhalten, einschließlich derjenigen, die Helme, Augen- und Körperschutzausrüstung, Fahrspurteilung und andere Straßenverkehrsregeln betreffen.Sie sind dafür verantwortlich, die Gesetze jeder Rechtsordnung, in der Sie das Motorrad betreiben, zu kennen und zu verstehen.
2. ?Verbotene Nutzung. Die folgende Nutzung des Motorrads oder Handlungen, die Sie oder ein anderer Fahrer vornehmen (oder nicht durchführen), stellen eine „Verbotene Nutzung" des Motorrads dar. Eine verbotene Nutzung ist eine wesentliche Verletzung dieser Vereinbarung und beinhaltet:
  1. die Verwendung des Motorrads zu folgenden Zwecken:
    1. ?Beförderung von Passagieren oder Fracht zu Mietzwecken;
    2. Anschieben oder Abschleppen eines anderen Motorrads oder eines anderen Objekts;
    3. Transport von Fracht für jeden rechtswidrigen Zweck;
    4. Beförderung von mehr als der vom Hersteller oder nach geltendem Recht angegebenen maximalen Anzahl von Fahrgästen oder zur Beförderung von Fahrgästen, die sich in einer anderen Position auf einem nicht zur Beförderung von Fahrgästen bestimmten Sitz befinden;
    5. Transportgut, das über das vom Hersteller angegebene Gewicht/Menge/Volumen hinausgeht;
    6. Transport von Gefahrgut oder gefährlichen Stoffen;
    7. Förderung illegaler Zwecke oder unter Umständen, die eine Straftat oder eine andere Rechtsverletzung darstellen würden (mit Ausnahme einer geringfügigen Verkehrsverletzung);
    8. Auf unbefestigten Straßen;
    9. Für Sportveranstaltungen oder Trackdays
    10. zum Transport eines Tieres (außer einem offiziellen Begleittier);
    11. wenn vernünftigerweise davon auszugehen ist, dass der weitere Betrieb das Motorrad beschädigen würde; und
    12. Im Zusammenhang mit einer vorsätzlichen, mutwilligen oder fahrlässigen Handlung.
  2. ?das Fahren des Motorrads außerhalb der Europäischen Union ohne vorherige Genehmigung des Vermieters;
  3. die Untervermietung oder Veräußerung, Verpfändung, Ausübung eines Pfandrechts, Verkauf oder Sicherheitsübereignung des Motorrads, der Ausstattung, der Werkzeuge und/oder des Zubehörs und eines Teils davon oder Verwendung mit dem Motorrad in einer Weise, die uns Schaden zufügt.
  4. die Überführung des Motorrads auf eine Insel ohne unsere vorherige schriftliche Genehmigung;
  5. die Überführung des Motorrads mit einer Fähre. Sollte der Kunde eine Fähre benutzen und es zu einem Unfall jeglicher Art kommen, ist er für alle Kosten für die Reparatur und/oder Rückführung des Motorrads verantwortlich. Selbst wenn Sie eine zusätzliche Deckung erwerben und sich für eine Fahrt mit einer Fähre entscheiden, ist die Deckung null und nichtig.
  6. die Verwendung durch eine Person:
    1. ?die kein zugelassener Fahrer ist;
    2. die keinen gültigen Führerschein für das Fahren eines Motorrads mit dieser Leistung hat;
    3. deren Führerschein eingezogen wurde;
    4. die unter dem Einfluss von verschreibungspflichtigen, nicht verschreibungspflichtigen Medikamenten oder Alkohol steht;
    5. die das Motorrad erworben oder den Mietzeitraum verlängert hat, wobei uns falsche, betrügerische oder irreführende Angaben gemacht wurden; und
    6. die das Motorrad bedient, während sie eine drahtlose, mit der Hand gehaltenes Kommunikationsgerät oder ein anderes Gerät verwendet, mit dem man telefonisch kommunizieren, Post oder Textnachrichten empfangen oder senden kann, ohne sich dabei im Freisprechmodus zu befinden.

ENTSCHÄDIGUNG; VORGEHEN BEI FORDERUNGEN

Entschädigung. Soweit gesetzlich zulässig, erklären Sie sich damit einverstanden, uns von allen Ansprüchen, Forderungen, Klagen, Haftungen, Kosten und Anwaltsgebühren freizustellen, die uns entstehen (zusammengefasst „Forderungen") oder die sich ergeben infolge dieser Vermietung und der Nutzung des Motorrads durch Sie oder seiner Wiederinbesitznahme durch uns, einschließlich von Ansprüchen, die aus der Beförderung von Fahrgästen auf dem Motorrad resultieren oder daraus entstehen.
Vorgehen bei Forderungen. Sie müssen: (i) alle Schäden an uns und alle Unfälle oder Vorfälle uns und der Polizei zu melden, sobald Sie sie entdecken (spätestens jedoch 24 Stunden nach dem Vorfall) und unser Formular zur Meldung von Vorfällen ausfüllen, das den Motorraddokumenten beigefügt ist; (ii) uns eine lesbare Kopie von Klagezustellungen zur Verfügung zu stellen, die sich auf einen Prozess, ein Rechtsmittel oder eine Mitteilung jeglicher Art im Zusammenhang mit einem Unfall oder anderen Vorfall mit dem Motorrad beziehen; und (iii) mit uns, der Polizei und unserer Versicherungsgesellschaft in allen nachfolgenden Ermittlungs- oder Gerichtsverfahren zusammenarbeiten. Der Versicherungsschutz im Rahmen der Police kann ungültig sein, wenn Sie das Motorrad einem nicht autorisierten Fahrer überlassen oder anderweitig gegen diesen Vertrag verstoßen; oder wenn Sie nicht an einer Schadensuntersuchung mitwirken oder einen rechtzeitigen und genauen Vorfallsbericht einreichen. Wir sind nicht verpflichtet, Ihnen ein Ersatzmotorrad zur Verfügung zu stellen, wenn das gemietete Motorrad verloren geht, beschädigt oder gestohlen werden sollte.

MAUTGEBÜHREN UND VERSTÖSSE

Sie sind dafür verantwortlich dafür, alle Mautgebühren („Maut") und Strafmandate für Falschparken, Gebühren für Bilder von Geschwindigkeitsüberwachungsgeräten, Bußgelder wegen Nichtzahlung der Maut und andere Bußgelder, Gebühren und Strafen (jeweils „Verstoß"), die gegen Sie, uns oder das Motorrad während dieser Vermietung verhängt wurden, direkt bezahlen. Wenn wir von den Gebühren erhebenden Behörden darüber informiert werden, dass wir für die Zahlung einer Verletzung verantwortlich sind, erklären Sie sich damit einverstanden, dass wir nach eigenem Ermessen die Haftung für alle Mautgebühren oder Verstöße, die während der Mietzeit gegen das Motorrad erhoben werden, auf Sie persönlich übertragen können. Wenn die Haftung auf Sie übergeht, berechnen wir Ihnen eine Verwaltungsgebühr von bis zu 50 € pro Maut oder Verletzung. Sie ermächtigen uns, Ihre Miet- und Abrechnungsinformationen, einschließlich der Zahlungskarteninformationen, an die Gebührenerhebungsbehörden zur Bearbeitung/Rechnung weiterzugeben. Hinweis: Bestimmte Mautstraßen akzeptieren kein Bargeld. Um Mautverstöße und damit verbundene Bußgelder, Gebühren und Steuern (und unsere Bearbeitungsgebühren) zu vermeiden, müssen Sie alle Mautgebühren mit einem persönlichen Transponder bezahlen, der auf der Straße akzeptiert wird; verwenden Sie nur die zur Bargeldzahlung vorgesehenen Fahrspuren; planen Sie eine Route zur Vermeidung von Mautgebühren; oder wenden Sie sich an die örtlichen Behörden für andere Zahlungsmethoden.

PERSÖNLICHE GEGENSTÄNDE

Wir sind nicht verantwortlich für den Verlust oder die Beschädigung von persönlichen Gegenständen, die bei uns zurückgelassen oder auf oder mit dem Motorrad mitgeführt wurden. Wenn Sie nicht mehr als 30 Tage lang das im Motorrad hinterlassene Eigentum geltend machen, können wir dieses Eigentum nach unserer Wahl veräußern. Soweit gesetzlich zulässig, verzichten Sie auf alle Ansprüche gegen uns, unsere Vertreter und Mitarbeiter aufgrund von Verlust oder Beschädigung Ihres persönlichen Eigentums oder das einer anderen Person, das wir erhalten, gehandhabt oder gelagert haben, oder das in oder auf dem Motorrad oder in einem Servicefahrzeug oder in unseren Büros hinterlassen oder getragen wurde, unabhängig davon, ob der Verlust des Schadens durch unsere Fahrlässigkeit verursacht wurde oder nicht oder anderweitig in unserer Verantwortung lag. Das Motorrad kann mit einem Infotainmentsystem ausgestattet sein, das es Ihnen ermöglicht, Ihre eigenen mobilen Geräte anzuschließen. Wenn Sie dies tun, beachten Sie bitte, dass das Motorrad möglicherweise automatisch Ihr Adressbuch lädt, Ihre eingehenden, ausgehenden und verpassten Anrufe sowie andere Informationen von Ihrem Gerät speichert. Sie sollten die auf dem Systembildschirm des Motorrads angezeigten Schritte befolgen, um diese Informationen und das Gerät aus dem Speicher des Motorrads zu löschen. Wir sind nicht verantwortlich für die Gewährleistung der Privatsphäre solcher Informationen und können nicht garantieren, dass andere Personen, die Sie nicht autorisieren, nach der Rückgabe des Motorrads Zugang zu diesen Informationen erhalten.

STREITBEILEGUNG; SCHIEDSGERICHTSBARKEIT

Diese Vereinbarung unterliegt dem portugiesischen Recht. Im Falle von Streitigkeiten kann der Verbraucher sich an eine Stelle der alternativen Streitbeilegung für Verbraucher oder an ein Gericht wenden. Die vertragsschließenden Parteien erklären, dass der Gerichtsstand Lissabon ist und verzichten ausdrücklich auf andere Gerichtsstände.

HINWEIS ZUR TELEMATIK

Das Motorrad kann mit der Global Positioning Satellite (GPS)-Technologie oder einem anderen Telematiksystem und/oder einem Ereignisdatenschreiber (EDR) ausgestattet sein. Sie erkennen an und autorisieren gemäß Punkt 16. PERSÖNLICHE INFORMATIONEN und durch Ihre persönlichen Zustimmung, dass die Nutzung dieses Motorrads von uns oder im Namen von uns über solche Systeme fernüberwacht werden kann, soweit dies gesetzlich zulässig ist. Diese Fernüberwachung kann die Erfassung von Motorrad-Daten beinhalten, wie z. B.: Standort, Kilometerzähler, Ölstandzeit, Kraftstoffstand, Reifendruck, Ladezustand der Batterie, Diagnosefehlercodes und andere Elemente, die wir für notwendig halten. Soweit gesetzlich zulässig, können wir das Motorrad deaktivieren, wenn wir es für notwendig halten, insbesondere wenn Sie gegen diesen Vertrag verstoßen. Diese Systeme können Mobilfunkkommunikation verwenden, und Sie sollten keine Erwartungen an die Privatsphäre im Zusammenhang mit Ihrer Nutzung dieses Motorrads haben. Sie erklären sich damit einverstanden, alle Fahrer und Beifahrer des Motorrads über die Bedingungen dieses Abschnitts zu informieren, und dass Sie die Freigabe von Informationen, die von GPS oder einem anderen Telematiksystem oder EDR erfasst wurden, genehmigt haben. Wir sind nicht verantwortlich für die Funktionsfähigkeit eines Telematik-Navigations- oder anderen Systems, das mit dem Motorrad geliefert wird. Soweit gesetzlich zulässig, erklären Sie sich damit einverstanden, uns von jeglichen Personen- oder Sachschäden freizustellen, die durch den Ausfall des GPS oder eines anderen Telematiksystems oder EDR oder anderweitig durch die Nutzung des GPS oder eines anderen Telematiksystems oder EDR entstehen.

PERSÖNLICHE INFORMATIONEN

Bei der Unterzeichnung des Vertrages muss der Mieter seine persönlichen Daten und die der anderen Fahrer des Fahrzeugs zum Zwecke der Identifizierung angeben, wobei er das Mietunternehmen ausdrücklich ermächtigt, die Daten elektronisch zu verarbeiten.
Gemäß der Verordnung (EU) 2016/679 des Europäischen Parlaments und des Rates vom 27. April 2016 (DSGVO) informiert das Mietunternehmen über Folgendes:
1. Die für die Verarbeitung der im Vertrag angegebenen personenbezogenen Daten verantwortliche Stelle ist HR Ride Portugal, SA, Hauptsitz in der Avenida Severiano Falcão 7-7A, 2689-522 Prior Velho; ;
2. Der Hauptzweck der Verarbeitung personenbezogener Daten ist der Abschluss und die Erfüllung dieses Vertrages gemäß Artikel 6 Absatz 1 Buchstabe b) der DSGVO;
3. Personenbezogene Daten können an einen Dritten weitergegeben werden, um den gesetzlichen Verpflichtungen nachzukommen, denen das Mietunternehmen gemäß Artikel 6 Absatz 1 Buchstabe c) der DSGVO unterliegt, nämlich Justizbehörden, Kriminalpolizei, Steuer- und Zollbehörden sowie Aufsichtsbehörden;
4. Personenbezogene Daten können für andere Zwecke verarbeitet werden, für die der Mieter dem Mietunternehmen ausdrücklich seine Zustimmung erteilen muss;
5. Das Mietunternehmen speichert die verarbeiteten personenbezogenen Daten für den Zeitraum, der für die Erbringung von Dienstleistungen, die Rechnungsstellung und die Erfüllung der gesetzlichen Verpflichtungen erforderlich ist.
Die betroffene Person hat jederzeit das Recht, auf ihre personenbezogenen Daten zuzugreifen sowie im Rahmen des Vertrages und der DSGVO diese zu berichtigen und ihrer Verarbeitung zu widersprechen, über die automatisierte Verarbeitung zu entscheiden, die Einwilligung zu widerrufen, die Löschung personenbezogener Daten zu verlangen und die im geltenden Recht vorgesehenen Rechte auszuüben (es sei denn, die Daten sind für die Erfüllung des Vertrages notwendig und daher zwingend erforderlich, sowie für die Erfüllung der gesetzlichen Verpflichtungen, denen das Mietunternehmen nachzukommen hat).
Widerruft der Mieter seine Zustimmung, so berührt dies nicht die Rechtmäßigkeit der bis zu diesem Zeitpunkt durchgeführten Verarbeitung.
Die betroffene Person hat das Recht, gemäß der DSGVO im Falle einer Verletzung personenbezogener Daten, die zu einer Gefährdung ihrer Rechte und Freiheiten führen kann, benachrichtigt zu werden, und kann einen Antrag bei der/den zuständigen Behörde(n) stellen.

F. Personenbezogene Daten können an Dritte weitergegeben werden, die dem Mietunternehmen Dienstleistungen erbringen, wenn diese Dienstleistungen die Übermittlung von Informationen aus den Mietverträgen erfordern.

Italien

HR Italia - noleggio veicoli e mobilità S.R.L., Hauptsitz in der Via di Novegro 49, 20090 Novegro (MI) - Italy, P. IVA n. 10319790969 (nachstehend „Vermieter“), vermietet das genannte Fahrzeug (Motorrad) im Rahmen dieses Mietvertrags, zu den dort geltenden spezifischen Bedingungen und nach Maßgabe der folgenden Allgemeinen Geschäftsbedingungen.

DEFINITIONEN
1. „Zusätzliche obligatorische Gebühren" sind gesondert ausgewiesene Gebühren, die Sie für die Zeit, für die der Mietpreis gilt, für die Miete oder das Leasing des Motorrads zahlen müssen und die von einer staatlichen Stelle erhoben werden und die sich speziell auf den Betrieb eines Mietwagengeschäfts beziehen. Zusätzliche obligatorische Gebühren umfassen eine Kundeneinrichtungsgebühr, Flughafenkonzessionsgebühr, Gebühr für die Tourismuskommission oder andere staatlich verordnete Steuern oder Gebühren.
2. „Vertrag" bezeichnet alle Bedingungen in diesen Allgemeinen Geschäftsbedingungen, dem „Mietvertrag", dem „Fahrzeugzustandsbericht", der Rechnung, der Risikoübernahme und Freigabe („Freigabe") und allen anderen Zusätzen, die wir zum Zeitpunkt der Vermietung bereitstellen (und die Sie unterschreiben).
3. „Autorisierter Fahrer" bezeichnet einen Fahrer, der zur Nutzung des Motorrads berechtigt ist. Sofern nicht ausdrücklich durch geltendes Recht genehmigt, sind nur der Vermieter und ein zusätzlicher Fahrer, der von uns zum Zeitpunkt der Anmietung auf der ersten Seite Ihres Vertrags aufgeführt ist, berechtigt, das Motorrad zu fahren. Jeder autorisierte Fahrer muss: (i) einen gültigen Führerschein in dem Land meines ständigen Wohnsitzes besitzen, der diese Person berechtigt, ein Motorrad mit dieser Leistung zu fahren; (ii) mindestens 21 Jahre alt sein und (iii) mindestens drei Jahre Erfahrung mit dem Fahren von Motorrädern mit dieser Leistung zu haben. Diese Bedingungen können sich je nach dem genannten Motorrad ändern.
4. „Gebühren" sind die Abgaben und Gebühren, die im Rahmen dieses Vertrags anfallen. Alle in dieser Vereinbarung genannten Beträge sind in Euro zu zahlen.
5. „CDW" steht für Collision Damage Waiver.
6. „Verminderter Wert" bezeichnet die Differenz zwischen dem Marktwert des Motorrads vor einem Schaden oder Verlust und seinem Wert nach der Reparatur, der durch von uns oder von einem Dritten in unserem Namen durchgeführte Schätzung berechnet wurde.
7. Ein „Nutzungsausfall“ liegt vor, wenn wir aufgrund von Schäden am Motorrad oder seinem Verlust das Motorrad während des Mietzeitraums nicht weiter für unsere Zwecke nutzen können. Dies schließt die Nutzung für den Verleih, die Anzeige zum Verleih und/oder zum Verkauf, die Möglichkeit zur Nachrüstung oder zum Verkauf oder die Beförderung von Mitarbeitern ein.
8. „Motorrad" oder „Fahrzeug" bezeichnet das im Mietvertrag bezeichnete Motorrad und jedes Fahrzeug, durch das wir es ersetzen, sowie sämtliche Reifen, Werkzeuge, Zubehörteile, Ausstattung, Geräte, Schlüssel und Fahrzeugdokumente.
9. „Mietzeitraum" bezeichnet den Zeitraum zwischen dem Zeitpunkt, zu dem Sie das Motorrad übernehmen, und dem Zeitpunkt, zu dem das Motorrad entweder an uns zurückgegeben oder von uns abgeholt und von uns eingecheckt wird.
10. „Mietportfolio" ist ein Dokument, das Ihnen am Mietort zur Einsichtnahme zur Verfügung steht und detaillierte Informationen über die zur Miete angebotenen Motorräder sowie eine aktualisierte Preisliste der Tagesmieten und sonstigen Gebühren („Preisliste") enthält. Die Preisliste kann sich ändern.
11. „Kfz-Steuer" oder „Anteilige Kfz-Steuer" bezeichnet die anteiligen Kosten an der jährlichen Kfz-Steuer, basierend auf dem geschätzten Tagessatz je Fahrzeug an unserer gesamten jährlichen Kfz-Steuer sowie auf den Kosten für die Besitzurkunde/KFZ-Brief und die Zulassungskosten bzw. wie nach geltendem Recht anderweitig definiert.
12. „Sie", „Ihnen" und "Ihr/e" steht für die Person, die als "Mieter" identifiziert wurde, und für jeden autorisierten Fahrer.
13. „Wir", „uns/er/e/er" oder steht für HR Italia - noleggio veicoli e mobilità S.R.L. Das Unternehmen Hertz hat uns autorisiert, den Namen „Hertz Ride" zu verwenden.

BUCHUNGSBEDINGUNGEN

Führerschein: Sowohl der Mieter als auch alle weiteren Fahrer müssen einen gültigen, nicht abgelaufenen Führerschein für die Klasse des gemieteten Motorrads (einschließlich aller erforderlichen Vermerke) in ihrem Namen vorlegen. Wenn Ihr Führerschein in Europa nicht ausgestellt wurde, müssen Sie auch einen internationalen Führerschein vorlegen. Die Fahrer müssen mindestens 21 Jahre alt sein und mindestens drei Jahre Fahrpraxis mit einem Motorrad dieser Leistung haben. Diese Bedingungen können sich je nach dem genannten Motorrad ändern.
Identitätsfeststellung: Reisepass oder Personalausweis
Kreditkarte: Der Mieter muss bei der Abholung des Motorrads über eine Kreditkarte (VISA oder MASTERCARD) auf seinen eigenen Namen verfügen (American Express, Dinners, Prepaid-Kreditkarte, Charge Card oder Geldkarten werden nicht akzeptiert). Zum Zeitpunkt der Anmietung müssen Sie uns für Ihre Kreditkarte eine Genehmigung (Block) für die Überschreitung der geschätzten Mietkosten zuzüglich einer Kaution/Garantie für die Selbstbeteiligung erteilen. Die Karte muss über genügend Deckung für den Block während der Dauer der Mietzeit verfügen. Wir berechnen auch alle zusätzlichen Gebühren, lokalen Abgaben, optionale, von ihnen gemietete Ausstattung oder alles andere, was Sie am Mietschalter zum Zeitpunkt der Vermietung auf die Kreditkarte kaufen.
Reservierungsbestätigung: Der Vermieter muss diese Reservierungsbestätigung bei der Abholung des Motorrads vorlegen. Weitere Informationen finden Sie in den Allgemeinen Geschäftsbedingungen.
Pannenhilfe: Im Ausgangsland ist Pannenhilfe rund um die Uhr verfügbar. Bitte fragen Sie am Schalter nach Details.
Zahlungsinformationen: Bei der Reservierung des Motorrads ist vom Mieter ein Geldbetrag als Buchungsanzahlung in Höhe von 25 % der Miete zu zahlen. Der Vermieter behält sich das Recht vor, die Verfügbarkeit des Motorrads vom Nachweis der tatsächlichen Entrichtung der Buchungsanzahlung durch den Vermieter abhängig zu machen. Die Vermietung muss innerhalb von maximal 12 Monaten ab dem Datum der Buchung erfolgen. Bitte beachten Sie, dass der „Gesamte, bei der Abholung zu zahlende Betrag in der Landeswährung berechnet wird. Beträge in anderen Währungen werden nur zu Informationszwecken angegeben.
Erweiterungen, Änderungen, Stornierungen und No-Show: Wenn Sie Ihren Mietvertrag über den auf dieser Reservierungsbestätigung angegebenen Abholtermin hinaus verlängern oder ändern möchten, müssen Sie sich direkt an Hertz Ride unter hertzride@hertzride.com und reservations@hertzride.com wenden, egal ob Sie das Motorrad tatsächlich abgeholt haben oder nicht. Eine Verlängerung oder Änderung Ihres Mietvertrages vor Mietbeginn (d.h. vor dem in dieser Reservierungsbestätigung angegebenen Abholdatum und -uhrzeit) kann nur durch Zusendung einer E-Mail an Hertz Ride (hertzride@hertzride.com) vereinbart werden. Bitte beachten Sie, dass die Änderung Ihrer Reservierung zu einer Änderung Ihres Mietpreises oder zu zusätzlichen oder höheren Gebühren aufgrund von Änderungen der Mietdauer oder des gemieteten Motorradtyps führen kann. Wenn Ihre geplante Abholzeit weniger als 48 Stunden beträgt und Sie Ihre Buchung ändern möchten, rufen Sie uns bitte an (+351 210 413 334). Ändert sich der Mietpreis aufgrund von Änderungen (z.B. Abhol- oder Rückgabeort, Motorradgruppe oder Mietdauer), wird Ihnen der zu diesem Zeitpunkt jeweils aktuell veröffentlichte Preis berechnet, der vom ursprünglich gebuchten Preis abweichen oder höher sein kann. Wenn die ursprüngliche Reservierung außerdem mit einer Werbe- oder Rabattaktion verknüpft war, haben Sie möglicherweise keinen Anspruch mehr auf damit verbundene Preisminderung, so dass die geänderte Reservierung möglicherweise wesentlich teurer ist. Sie erhalten keine Gutschrift oder Rückerstattung, wenn Sie das gemietete Motorrad früher als geplant zurückgeben.
1. Änderungen: Änderungen der Reservierungen können nur per E-Mail an unser Contact Center unter reservations@hertzride.com vorgenommen werden. Die geschätzten Gesamtkosten werden auf der Grundlage der Verfügbarkeit und der Preise zum Zeitpunkt der Änderung neu berechnet. Die Gesamtkosten können höher oder niedriger als der ursprünglich gebuchte Preis sein. Diese Richtlinie gilt für Änderungen von: Rückgabeort, Abholdatum und -zeit, Rückgabezeit und -datum, Motorradgruppe, alle weiteren Zusatzprodukte
2. Stornierungen: Wenn Sie Ihre Reservierung stornieren möchten, müssen Sie Hertz Ride vor Mietbeginn schriftlich unter reservations@hertzride.com informieren - es können Stornogebühren anfallen. Die bei der Reservierung geleistete Zahlung wird nur zurückerstattet, wenn die Reservierung mindestens 30 Tage vor dem geplanten Abholtermin storniert wird.
3. No-Show: Hertz Ride behält sich das Recht vor, das Motorrad Benutzern zu verweigern, die nicht pünktlich ankommen (Gewährung einer 30-minütigen „Kulanzfrist "), nicht alle erforderlichen Unterlagen und/oder Informationen zur Verfügung stellen, keine Kreditkarte mit genügend Deckung für die Kaution zur Verfügung stellen oder wenn der Fahrer unter dem Einfluss von Alkohol, Drogen oder anderen Substanzen zu stehen scheint, die seine Wahrnehmung oder Reaktionen beeinträchtigen oder anderweitig als ungeeignet für den Betrieb des Motorrads erscheint. In solchen Fällen wird der Mieter, sofern der Mietvertrag nicht im Voraus storniert wurde, als „No-Show" erachtet und hat keinen Anspruch auf eine Rückerstattung. Die Preise basieren auf den Abhol- und Rückgabezeiten und -daten, die der Nutzer vor Mietbeginn vereinbart. Wenn der Benutzer das Motorrad später abholt oder das Motorrad früher zurückbringt, erhält er keine Rückerstattung für die nicht genutzten Stunden oder Tage.
Extras: Alle Extras, Zusatzausstattungen und Dienstleistungen, einschließlich GPS, Helme, Kommunikationssystem und niedrige Sitze, sind abhängig von der lokalen Verfügbarkeit, die nicht garantiert werden kann. (Bsp.: GPS, Helme, Intercom-System und niedrige Sitze) Alle zusätzlichen optionalen Ausstattungen werden „wie besehen" zur Verfügung gestellt, und Sie sind dafür verantwortlich, dass Ihnen die Verwendung und/oder Installation der optionalen Ausstattung bekannt ist
Optionale Deckung für besondere Schäden: Am Schalter kann der Kunde einen zusätzlichen Deckungsschutz für die Haftung bei Schäden abschließen. Bitte erkundigen Sie sich bei unserem Kundendienstmitarbeiter vor Ort nach den Bedingungen für die Hinzufügung dieser Leistungen.
1. SCDW – Mittlerer Deckungsschutz: Wenn Sie Super CDW erwerben, verzichten wir auf unser Recht, Sie für Kollisionsschäden haftbar zu machen - und zwar bis zu einem Höchstbetrag von 50 % des Marktwertes des Motorrads vor dem Schaden. Die Preise variieren zwischen 19 € und 25 € pro Tag, wobei ein Minimum von 5 Tagen pro Anmietung erforderlich ist.
2. VIP SCDW - Top-Deckungsschutz: Wenn Sie Super CDW VIP erwerben, verzichten wir auf unser Recht, Sie für Kollisionsschäden haftbar zu machen - und zwar bis zu einem Höchstbetrag von 75 % des Marktwertes des Motorrads vor dem Schaden. Die Preise variieren zwischen 35 € und 39 € pro Tag, wobei ein Minimum von 5 Tagen pro Anmietung erforderlich ist.

Tagesmietpreis für die Mietperiode, einschließlich einer zusätzlichen Kilometergebühr, wenn Sie den auf der Vorderseite des Mietvertrages angegebenen Tageskilometerstand überschreiten;
Eine auf unseren Erfahrungswerten basierende Kilometerpauschale, wenn der Kilometerzähler manipuliert oder deaktiviert ist;
Gebühren für optionale Produkte, Ausstattungen und Dienstleistungen, die Sie gekauft haben;
Kraftstoff und eine Tankgebühr, wenn Sie das Motorrad mit weniger Kraftstoff als bei der Anmietung zurückgeben;
Zusätzliche obligatorische Gebühren;
Kosten, die uns bei der Lokalisierung und Bergung des Motorrads entstehen, wenn Sie es nicht zurückgeben oder wenn wir es gemäß den Bedingungen dieses Vertrags wieder in Besitz nehmen;
Alle Kosten, die uns durch die Durchsetzung oder Verteidigung unserer Rechte aus diesem Vertrag entstehen;
Eine angemessene Reinigungsgebühr gemäß Preisliste für die Reinigung des Motorrads, wenn es deutlich schmutziger zurückgegeben wird als bei der Vermietung;
Eine Gebühr für verlorene Schlüssel, wenn Sie die Schlüssel des Motorrads verlieren;
Einen Zuschlag, wenn Sie das Motorrad an einem anderen Ort als dem, an dem Sie das Motorrad gemietet haben, zurückgeben („Drop Fee") oder wenn Sie es nicht zu dem in Absatz 2 beschriebenen Datum und Uhrzeit zurückgeben („Late Fee");
Kosten für Abschleppen, Lagerung, Konfiszierung, Gerichtskosten, Strafen und alle anderen Kosten, die uns durch Ihre Nutzung des Motorrads entstehen;
Wiederbeschaffungskosten für verloren gegangene oder beschädigte Teile und Verbrauchsmaterialien, die für das Motorradzubehör oder Zusatzausrüstungen wie Helme, Intercom-Systeme, niedrigere Sitze oder Navigationssysteme verwendet werden; und
Die Kosten für die Beschaffung von Ersatzdokumenten zuzüglich einer angemessenen Verwaltungsgebühr, wenn Sie eines der Motorraddokumente, einschließlich der Fahrzeugzulassung, verlieren oder beschädigen.

ZUSÄTZLICHE DECKUNG (SCHADENSHAFTUNG)

NUTZUNGSBEDINGUNGEN UND VERBOTENE NUTZUNG
1. Nutzungsbedingungen während der Mietdauer:
  1. Sie müssen das Motorrad sicher parken.Wenn das Motorrad beispielsweise nicht in Gebrauch ist, müssen Sie das Lenkrad verriegeln und blockieren und alle Dokumente des Motorrads aufbewahren.
  2. Sie stimmen zu, nur Kraftstoff zu verwenden, der den Spezifikationen des Herstellers entspricht, und regelmäßig Öl- und Wasserstände, Reifendruck und alle anderen grundlegenden Systeme des Motorrads zu überwachen.
  3. Nur die Person oder Personen, die vom Mietunternehmen als autorisierte Fahrer definiert und akzeptiert wurden, sind berechtigt, das Motorrad zu fahren.
  4. Sie erklären sich damit einverstanden, alle für Ihre Nutzung des Motorrads geltenden Gesetze einzuhalten, einschließlich derjenigen, die Helme, Augen- und Körperschutzausrüstung, Fahrspurteilung und andere Straßenverkehrsregeln betreffen.Sie sind dafür verantwortlich, die Gesetze jeder Rechtsordnung, in der Sie das Motorrad betreiben, zu kennen und zu verstehen.
2. ?Verbotene Nutzung. Die folgende Nutzung des Motorrads oder Handlungen, die Sie oder ein anderer Fahrer vornehmen (oder nicht durchführen), stellen eine „Verbotene Nutzung" des Motorrads dar. Eine verbotene Nutzung ist eine wesentliche Verletzung dieser Vereinbarung und beinhaltet:
  1. die Verwendung des Motorrads zu folgenden Zwecken:
    1. ?Beförderung von Passagieren oder Fracht zu Mietzwecken;
    2. Anschieben oder Abschleppen eines anderen Motorrads oder eines anderen Objekts;
    3. Transport von Fracht für jeden rechtswidrigen Zweck;
    4. Beförderung von mehr als der vom Hersteller oder nach geltendem Recht angegebenen maximalen Anzahl von Fahrgästen oder zur Beförderung von Fahrgästen, die sich in einer anderen Position auf einem nicht zur Beförderung von Fahrgästen bestimmten Sitz befinden;
    5. Transportgut, das über das vom Hersteller angegebene Gewicht/Menge/Volumen hinausgeht;
    6. Transport von Gefahrgut oder gefährlichen Stoffen;
    7. Förderung illegaler Zwecke oder unter Umständen, die eine Straftat oder eine andere Rechtsverletzung darstellen würden (mit Ausnahme einer geringfügigen Verkehrsverletzung);
    8. Auf unbefestigten Straßen;
    9. Für Sportveranstaltungen oder Trackdays
    10. zum Transport eines Tieres (außer einem offiziellen Begleittier);
    11. wenn vernünftigerweise davon auszugehen ist, dass der weitere Betrieb das Motorrad beschädigen würde; und
    12. Im Zusammenhang mit einer vorsätzlichen, mutwilligen oder fahrlässigen Handlung.
  2. ?das Fahren des Motorrads außerhalb der Europäischen Union ohne vorherige Genehmigung des Vermieters;
  3. die Untervermietung oder Veräußerung, Verpfändung, Ausübung eines Pfandrechts, Verkauf oder Sicherheitsübereignung des Motorrads, der Ausstattung, der Werkzeuge und/oder des Zubehörs und eines Teils davon oder Verwendung mit dem Motorrad in einer Weise, die uns Schaden zufügt.
  4. die Überführung des Motorrads auf eine Insel ohne unsere vorherige schriftliche Genehmigung;
  5. die Überführung des Motorrads mit einer Fähre. Sollte der Kunde eine Fähre benutzen und es zu einem Unfall jeglicher Art kommen, ist er für alle Kosten für die Reparatur und/oder Rückführung des Motorrads verantwortlich. Selbst wenn Sie eine zusätzliche Deckung erwerben und sich für eine Fahrt mit einer Fähre entscheiden, ist die Deckung null und nichtig.
  6. die Verwendung durch eine Person:
    1. ?die kein zugelassener Fahrer ist;
    2. die keinen gültigen Führerschein für das Fahren eines Motorrads mit dieser Leistung hat;
    3. deren Führerschein eingezogen wurde;
    4. die unter dem Einfluss von verschreibungspflichtigen, nicht verschreibungspflichtigen Medikamenten oder Alkohol steht;
    5. die das Motorrad erworben oder den Mietzeitraum verlängert hat, wobei uns falsche, betrügerische oder irreführende Angaben gemacht wurden; und
    6. die das Motorrad bedient, während sie eine drahtlose, mit der Hand gehaltenes Kommunikationsgerät oder ein anderes Gerät verwendet, mit dem man telefonisch kommunizieren, Post oder Textnachrichten empfangen oder senden kann, ohne sich dabei im Freisprechmodus zu befinden.

ENTSCHÄDIGUNG; VORGEHEN BEI FORDERUNGEN

Entschädigung. Soweit gesetzlich zulässig, erklären Sie sich damit einverstanden, uns von allen Ansprüchen, Forderungen, Klagen, Haftungen, Kosten und Anwaltsgebühren freizustellen, die uns entstehen (zusammengefasst „Forderungen") oder die sich ergeben infolge dieser Vermietung und der Nutzung des Motorrads durch Sie oder seiner Wiederinbesitznahme durch uns, einschließlich von Ansprüchen, die aus der Beförderung von Fahrgästen auf dem Motorrad resultieren oder daraus entstehen.
Vorgehen bei Forderungen. Sie müssen: (i) alle Schäden an uns und alle Unfälle oder Vorfälle uns und der Polizei zu melden, sobald Sie sie entdecken (spätestens jedoch 24 Stunden nach dem Vorfall) und unser Formular zur Meldung von Vorfällen ausfüllen, das den Motorraddokumenten beigefügt ist; (ii) uns eine lesbare Kopie von Klagezustellungen zur Verfügung zu stellen, die sich auf einen Prozess, ein Rechtsmittel oder eine Mitteilung jeglicher Art im Zusammenhang mit einem Unfall oder anderen Vorfall mit dem Motorrad beziehen; und (iii) mit uns, der Polizei und unserer Versicherungsgesellschaft in allen nachfolgenden Ermittlungs- oder Gerichtsverfahren zusammenarbeiten. Der Versicherungsschutz im Rahmen der Police kann ungültig sein, wenn Sie das Motorrad einem nicht autorisierten Fahrer überlassen oder anderweitig gegen diesen Vertrag verstoßen; oder wenn Sie nicht an einer Schadensuntersuchung mitwirken oder einen rechtzeitigen und genauen Vorfallsbericht einreichen. Wir sind nicht verpflichtet, Ihnen ein Ersatzmotorrad zur Verfügung zu stellen, wenn das gemietete Motorrad verloren geht, beschädigt oder gestohlen werden sollte.

Bei der Unterzeichnung des Vertrages muss der Mieter seine persönlichen Daten und die der anderen Fahrer des Fahrzeugs zum Zwecke der Identifizierung angeben, wobei er das Mietunternehmen ausdrücklich ermächtigt, die Daten elektronisch zu verarbeiten.
Gemäß der Verordnung (EU) 2016/679 des Europäischen Parlaments und des Rates vom 27. April 2016 (DSGVO) informiert das Mietunternehmen über Folgendes:
1. Die für die Verarbeitung der im Vertrag angegebenen personenbezogenen Daten verantwortliche Stelle ist HR Ride Portugal, SA, Hauptsitz in der Avenida Severiano Falcão 7-7A, 2689-522 Prior Velho; ;
2. Der Hauptzweck der Verarbeitung personenbezogener Daten ist der Abschluss und die Erfüllung dieses Vertrages gemäß Artikel 6 Absatz 1 Buchstabe b) der DSGVO;
3. Personenbezogene Daten können an einen Dritten weitergegeben werden, um den gesetzlichen Verpflichtungen nachzukommen, denen das Mietunternehmen gemäß Artikel 6 Absatz 1 Buchstabe c) der DSGVO unterliegt, nämlich Justizbehörden, Kriminalpolizei, Steuer- und Zollbehörden sowie Aufsichtsbehörden;
4. Personenbezogene Daten können für andere Zwecke verarbeitet werden, für die der Mieter dem Mietunternehmen ausdrücklich seine Zustimmung erteilen muss;
5. Das Mietunternehmen speichert die verarbeiteten personenbezogenen Daten für den Zeitraum, der für die Erbringung von Dienstleistungen, die Rechnungsstellung und die Erfüllung der gesetzlichen Verpflichtungen erforderlich ist.
Die betroffene Person hat jederzeit das Recht, auf ihre personenbezogenen Daten zuzugreifen sowie im Rahmen des Vertrages und der DSGVO diese zu berichtigen und ihrer Verarbeitung zu widersprechen, über die automatisierte Verarbeitung zu entscheiden, die Einwilligung zu widerrufen, die Löschung personenbezogener Daten zu verlangen und die im geltenden Recht vorgesehenen Rechte auszuüben (es sei denn, die Daten sind für die Erfüllung des Vertrages notwendig und daher zwingend erforderlich, sowie für die Erfüllung der gesetzlichen Verpflichtungen, denen das Mietunternehmen nachzukommen hat).
Widerruft der Mieter seine Zustimmung, so berührt dies nicht die Rechtmäßigkeit der bis zu diesem Zeitpunkt durchgeführten Verarbeitung.
Die betroffene Person hat das Recht, gemäß der DSGVO im Falle einer Verletzung personenbezogener Daten, die zu einer Gefährdung ihrer Rechte und Freiheiten führen kann, benachrichtigt zu werden, und kann einen Antrag bei der/den zuständigen Behörde(n) stellen.

BOOKING CONDITIONS

Driving License: Both the renter and any additional drivers must provide a valid, unexpired driver’s license for the class of motorcycle rented (including any necessary endorsements) in their name. If your driver’s license is not issued in Europe, then you must also bring an international driving permit. Drivers need to be at least age 21 and have at least three year of experience riding motorcycles with the same rating as the Motorcycle. These conditions may change according with the motorcycle identified.
Identification: A passport or personal ID card is required
Credit Card: The renter must have a credit card (VISA or MASTERCARD) in his or her own name when picking up the motorcycle (American Express, Dinners, prepaid credit card, charge card or cash cards will not be accepted). At the time of rental, we will request an authorization (hold) on your credit card for the excess of the estimated rental charges plus Non-Waivable Excess (NWE) deposit/ guarantee. The card must have enough available funds to cover the hold for the duration of the rental). We will also charge all additional charges, local fees, optional equipment that you rent or anything else that you purchase at the rental counter to the credit card at the time of rental.
Reservation confirmation: The renter must present this Reservation Confirmation when picking up the motorcycle. Refer to the Terms and Conditions for more information.
Roadside Assistance: You have available road assistant 24h in the original country. Please ask at desk for details.
Payment Information: The booking of the motorcycle requires the payment by the Renter of monetary amount as a reserve deposit corresponding to 20% of the rental. The Rental Company reserves the right to make the availability of the motorcycle conditional to the effective demonstration by the Renter of the payment of the reservation deposit. The rental must be made within a maximum of 12 months from the date of reservation. Please note that ´Total Amount to pay on pick up’ will be charged in local currency. Any other currency displayed is for information purposes only.
Extensions, Amendments, Cancellations and No-Shows: If you wish to extend or modify your rental after the pick-up date and time specified on this Reservation Confirmation, you must contact your Hertz Ride pick-up location using the e-mail address before your rental is due to start. Check Hertz Ride Location contacts at our website whether you have actually picked up the motorcycle or not. Extension or modification of your rental before the rental starts (i.e., before the pick-up date and time specified on this Reservation Confirmation) may only be arranged by sending an email to your Hertz Ride pick-up location. Check Hertz Ride Location contacts at our website. Please note that modifying your reservation may result in a change in your rental rate or additional or higher charges based on changes to the length of the rental or to the motorcycle type rented. If your scheduled pick-up time is less than 48 hours away and you wish to modify your booking, please call your pick-up location. Check Hertz Ride Location contacts at our website. If the rental price changes due to modifications (e.g., pick-up or drop-off location, motorcycle group or length of rental), you will be charged at the current published price, which may be different or higher from the initial price booked. In addition, if the original reservation was subject to a promotional or discounted fee, you may no longer qualify for that fee, and the modified reservation may be at a substantially higher rate. You will not receive a credit or refund if you return the rented motorcycle earlier than the scheduled due-in date and time.

Modifications: Modifications to reservations can only be made using the e-mail address before your rental is due to start. Check Hertz Ride Location contacts at our website. The estimated total charges will be recalculated based on the availability and prices at the time the modification is made. The total charges may be greater or lesser than the price originally booked. This policy applies to changes made to: Drop off location, pick up date and time, Drop off time and date, Motorcycle group, All other additional products.
Cancellations: If you wish to cancel your reservation, you must inform your Hertz Ride pick-up location using the e-mail address before your rental is due to start. Check Hertz Ride Location contacts at our website - cancellation fees may apply. The payment made at the time of reservation is refundable only if the reservation is canceled at least 30 days before the scheduled pick-up date.
No Shows: Hertz Ride reserves the right to refuse the motorcycle to any user who fails to arrive on time (including a 30-minute “grace period”), fails to provide all the necessary documentation and/or information, fails to provide a credit card with enough available funds for the deposit; or if the driver show signs of being under the influence of alcohol, drugs or any other substance affecting his perception or reactions or otherwise appears unfit to operate the motorcycle. In such cases, unless the rental has been cancelled in advance, the renter will be considered a “no show” and will not be entitled to a refund. The prices are based on the pick-up and drop-off times and dates that the user arranges before the rental starts. If the user picks the motorcycle up any later or brings the motorcycle back any earlier, the user will not receive a refund for the unused hours or days.

Extras: All extras extra, optional equipment and services, including GPS, Helmets, Communications system, and low seats, are subject to local availability and availability cannot be guaranteed. (Ex: GPS, Helmets, Intercommunication System and Low seats). All extra optional equipment is provided “As-Is,” and you are responsible for ensuring that you understand how to use and/or install any of the optional equipment.
Optional Special Damage Coverage: At the counter, costumer can opt to add additional coverage regarding damage responsibility. Please ask our Customer Sale Representative at the location about conditions to add these coverages.

NATURE OF THE AGREEMENT

This Agreement is a contract for the rental of the Motorcycle. You may not transfer or assign your rights in this Agreement or your right to use the Motorcycle.
You understand that we are not an affiliate, agent or franchisee of The Hertz Corporation (or any of its affiliates) (collectively “Hertz”). We are an independently owned and operated company with a limited license from Hertz to use the name, “Hertz Ride” in connection with a motorcycle rental business in the United States. You further understand and agree that Hertz is not a party to this Agreement and has no obligations to you. You further agree that you will not make any demands or pursue any claims against Hertz.

CONDITION OF THE MOTORCYCLE – DELIVERY AND RETURN

The Renter acknowledges receiving the Motorcycle in good working and clean condition, including both tires, and agrees to return it to us in the same condition (with its keys, equipment, tools and/or accessories) at the location and on the date specified in the Rental Agreement.

You are prohibited from modifying any technical features of the Motorcycle or its keys, equipment, tires, tools and/or accessories or from making any aesthetic change to the Motorcycle. If you breach this provision, you will be responsible for all costs that we incur to restore the Motorcycle to its original status plus, to the extent permitted by law, consequential and incidental damages due to our inability to use the Motorcycle while it is being repaired.

To the extent permitted by law: (a) we may repossess the Motorcycle at your expense without notice to you if it is abandoned or used in violation of law or this Agreement; and (b) if the Motorcycle is not returned 48 hours after the date and hour return time as stipulated in the Rental Agreement, it will be considered embezzled or converted and may be reported to the police as stolen. Failure to return the Motorcycle may constitute a crime punishable to the fullest extent provided under applicable law.

RENTAL PERIOD

The minimum Rental Period is one day. A “day” is a 24-hour period beginning on the date and time noted on the Rental Agreement. If you return the Motorcycle more than 29 minutes after the scheduled return time, we reserve the right to charge you for an additional rental day at the applicable daily rate as shown on the Price List. If you wish to extend the scheduled Rental Period, you must request our express written authorization and pay for the estimated additional charges before the scheduled return time. Under no circumstances may the deposit be used as form of payment in case of extension of the Agreement. If you fail to return the Motorcycle when due and continue to use it without our express authorization, we may terminate this Agreement, and you will have sole responsibility for the payment of any fines or penalties assessed against you, the Motorcycle or us due to the lack of updated documentation.

RENTAL RATE AND DEPOSIT

The daily rental rate, as well as the deposit amount, are determined by the Price List in effect when you sign this Agreement. The standard payment method is credit card. Payment by cash or debit card requires our prior authorization and may be subject to additional conditions. If we authorize payment in cash, we reserve the right to request one or more credit cards of the Renter as guarantee. You permit us to reserve against your payment card (or, if we choose, take a cash deposit) at the time of rental a reasonable amount in addition to the estimated total charges. We may use the reserve or deposit to pay all Charges. We will authorize the release of an excess reserve (or return of a cash deposit) at completion of your rental if no additional Charges are payable. Your payment card issuer’s rules will apply to crediting your account for any excess, which may not be immediately released by your card issuer.

CHARGES

All Charges are based on our current Price List, which is available for your review at the rental counter. All Charges are payable in U.S. dollars. You will pay us at or before conclusion of rental, or on demand, all Charges, including:

Daily Rental Rate for the Rental Period, including an additional mileage fee if you exceed the daily mileage allowance indicated on the Rental Agreement Face Page;
A mileage charge based on our experience if the odometer is tampered with or disconnected;
Fees for optional products, equipment, and services you purchase, which may include (subject to availability): (i) Intercom system; (ii) Cellphone holder; (iii) Wi-Fi hotspot; (iv) Navigation equipment; (v) helmet; or (vi) jacket.
Fuel and a refueling fee if you return the Motorcycle with less fuel than when rented;
Additional Mandatory Charges;
Expenses we incur locating and recovering the Motorcycle if you fail to return it or if we repossess it under the terms of this Agreement;
All costs we incur enforcing or defending our rights under this Agreement;
A reasonable cleaning fee as noted on the Price List to clean the Motorcycle if returned substantially less clean than when rented;
A lost key fee if you lose the keys to the Motorcycle;
A surcharge if you return the Motorcycle to a location other than the location where you rented the Motorcycle (“Drop Fee”) or if you do not return it on the date and time due as further described in Paragraph 3 above (“Late Fee”);
A delivery or pick-up fee if we deliver or pick-up the Motorcycle from you;
Additional Driver Fees (except in California);
Towing, storage charges, forfeitures, court costs, penalties and all other costs we incur from your use of the Motorcycle;
Replacement cost of lost or damaged parts and supplies used in the Motorcycle accessories or optional equipment, such as helmets, intercom systems, lowered seats, or navigation systems; and
The cost of obtaining replacement documents plus a reasonable administrative fee if you lose or damage any of the Motorcycle documents, including the vehicle registration.

There is no refund for late pick-up or early return. If you use a credit card or other payment card issued by a bank or financial institution outside of the United States, we will charge your credit card in US dollars. Any currency conversion will be handled by the issuing bank. All Charges are subject to our final audit. If errors are discovered after the close of this transaction, you authorize us to correct the Charges with the payment card issuer. You must notify us of any disputes to the Charges no later than 30 days after your receipt of the invoice.

NO WARRANTIES; NO LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT WE AND THE MANUFACTURER OF THE MOTORCYCLES AND ITS AFFILIATES (THE ‘MANUFACTURERS”) HAVE NOT MADE, DO NOT MAKE, AND DISCLAIM ANY REPRESENTATION OR WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, WITH RESPECT TO THE MOTORCYCLE, INCLUDING, ITS DESIGN, CAPACITY, CONDITION, MERCHANTABILITY, OR FITNESS FOR USE OR FOR ANY PARTICULAR PURPOSE; AND (B) AGREE THAT NEITHER US NOR THE MANUFACTURERS WILL BE LIABLE TO YOU FOR ANY LOSS OR OTHER DAMAGES OR EXPENSES OF ANY KIND CAUSED DIRECTLY OR INDIRECTLY BY, OR ARISING IN CONNECTION WITH, THE MOTORCYCLE, ITS USE, OPERATION OR FAILURE TO BE MAINTAINED, OR BY ANY INTERRUPTION OF SERVICE OR LOSS OF USE OF THE MOTORCYCLE.

RESPONSIBILITY FOR DAMAGE OR LOSS OF THE MOTORCYCLE

You must report all accidents or incidents of theft or vandalism to us and the police as soon as you discover them.

Unless otherwise limited by paragraph 8(B), you are responsible for all damage to or loss or theft of the Motorcycle during the Rental Period, regardless of fault, resulting from any cause, including damage of loss caused by collision, weather, vandalism, theft, road conditions and acts of nature. Your responsibility will include: (a) all physical damage to the Motorcycle measured as follows: (i) if we determine that the Motorcycle is a total loss, the fair market value of the Motorcycle, less salvage; (ii) if we determine that the Motorcycle is repairable: (A) the difference between the value of the Motorcycle immediately before the damage and the value immediately after the damage; or (B) the reasonable estimated retail value or actual cost of repair plus Diminished Value; (b) Loss of Use, measured by multiplying your daily rental rate either by the actual or estimated number of days from the date the Motorcycle is damaged until it is replaced or repaired, which you agree represents a reasonable estimate of Loss of Use damages and not a penalty. Loss of Use shall be payable regardless of fleet utilization; (c) a reasonable administrative fee, calculated based on the damage repair estimate as follows, which you agree is reasonable: $0-$250 damage=$50 fee; $251-$500 damage=$75 fee; $501-$750 damage=$100 fee; $751-$1500 damage=$150 fee; $1501-$2500 damage=$200 fee; over $2500 damage=$250 fee; (d) towing, storage, and impound charges and other reasonable incidental and consequential damages; and (e) all costs associated with our enforcement of this Agreement.
YOUR RESPONSIBILITY FOR DAMAGE OR LOSS IS LIMITED BY LAW IN THE FOLLOWING JURISDICTIONS. In the following jurisdictions, your responsibility for damage or loss will governed by the following paragraphs; in all other jurisdictions, your responsibility for damage or loss will be governed by paragraph 8(A), above.

FOR RENTALS COMMENCING IN CALIFORNIA: You are responsible for all damage to or loss of the Motorcycle caused by collision, regardless of fault. Subject to limits of California law, your responsibility includes: (a) all physical and mechanical damage to the Motorcycle measured as follows: (i) if we determine that the Motorcycle is a total loss, the fair market value of the Motorcycle less salvage; (ii) if we determine that the Motorcycle is repairable, the actual or estimated cost of the repairs performed; (b) an administrative fee; and (c) our actual charges for towing, storage, and impound. You are responsible for loss due to theft of the Motorcycle and damage caused by vandalism that occurs in connection with a theft if you fail to exercise ordinary care while in possession of the Motorcycle. You are responsible for damage due to vandalism not associated with theft of the Motorcycle up to a maximum of $500. You are responsible for replacing missing equipment and Motorcycle documents and keys. You must report all Motorcycle accidents and incidents of theft or vandalism to us and the police upon discovery.

FOR RENTALS COMMENCING IN ILLINOIS: You are responsible for all damage, loss or theft of the Motorcycle during the Rental Period resulting from any cause, including collision, weather, vandalism, and road conditions. Your responsibility includes: (a) all physical and mechanical damage to the Motorcycle as follows: (i) if we determine that the Motorcycle is a total loss, the fair market value of the Motorcycle, less salvage; (ii) if we determine that the Motorcycle is repairable, the lesser of: (A) the actual or reasonable estimated retail value or actual cost of repair; and (B) the fair market value of the Motorcycle immediately before the damage or loss; (b) Loss of Use, measured by multiplying your daily rental rate by the actual or estimated number of days from the date of Motorcycle damage until it is replaced or repaired divided by 4, which you agree is a reasonable estimate of Loss of Use damages, not a penalty, and payable regardless of fleet utilization; (c) a reasonable administrative fee for expenses we incur processing a damage claim; and (d) towing, storage, and impound charges. You are responsible for replacing missing equipment and Motorcycle documents and keys. You must report all Motorcycle accidents and incidents of theft or vandalism to us and the police upon discovery. Motorcycle MSRP of $50,000 or less: Your responsibility for loss or damage due to causes other than theft will not exceed $19,500. Beginning June 1, 2021, the maximum amount we may recover will increase by $500 on June 1st of each year. You also are responsible for loss due to theft of the Motorcycle up to a maximum of $2,000, unless you fail to exercise ordinary care while in possession of the Motorcycle. If you committed, or aided in, the theft of the Motorcycle, you will be liable up to the Motorcycle’s fair market value. Motorcycle MSRP over $50,000: Your responsibility for loss or theft or damage to the Motorcycle will not exceed $50,000. Beginning October 1, 2020, the maximum amount that we may recover will increase by $1,000 on October 1st of each year.

COLLISION DAMAGE WAIVER

If you purchase CDW, we will waive our right to hold you financially responsible for all or a portion of collision damage to the Motorcycle as noted on the current Price List. Where permissible, we also offer “Super CDW,” and “Super CDW VIP.” If you purchase Super CDW, your financial responsibility for collision damage to the Motorcycle will be limited to the amount noted on the current Price List. If you purchase Super CDW VIP, your financial responsibility for collision damage to the Motorcycle will be limited to the amount noted on the current Price List. Super CDW and Super CDW VIP are not available in California. CDW, Super CDW, and Super CDW VIP are not insurance, are optional, and may duplicate coverage under your own insurance policy or credit card. CDW, Super CDW, and Super CDW VIP do not apply to Optional Equipment we rent to you for use in the Motorcycle. CDW, Super CDW, Super CDW VIP also do not cover locked keys. Your CDW, Super CDW, or Super CDW VIP will be invalidated, and we will not waive our right to hold you financially responsible for collision damage to the Motorcycle that results from a Prohibited Use (defined in Paragraph 10 below), except in the following states, where the following state-specific conditions described below apply:

FOR RENTALS COMMENCING IN CALIFORNIA: You are responsible for all collision damage to the Motorcycle, even if someone else caused it or the cause is unknown. You are responsible for the cost of repair up to the value of the Motorcycle, towing, storage, and impound fees. Your own insurance, or the issuer of the credit card you use to pay for the rental may cover all or part of your financial responsibility for damage to, or loss of, the rented motorcycle. You should check with your insurance company, or credit card issuer, to find out about your coverage and the amount of deductible, if any, for which you may be liable. If you use a credit card that provides coverage for your responsibility for damage to, or loss of, the Motorcycle, you should check with the issuer to determine whether or not you must first exhaust the coverage limits of your own insurance before the credit card coverage applies. We will not hold you responsible for damage to or loss of the Motorcycle if you buy CDW. But, CDW will not protect you if: (a) if you provided fraudulent information to us or if you provided false information to us and we would not have rented the Motorcycle had we received true information; (b) if damage to or loss of the Motorcycle results from: (i) your intentional, willful, wanton, or reckless conduct; (ii) operation of the Motorcycle under the influence of drugs or alcohol in violation of § 23152 of the California Vehicle Code; or (iii) towing or pushing anything, or operation of the Motorcycle on an unpaved road if the damage or loss is a direct result of the road or driving conditions; or (c) if damage to or loss of the Motorcycle occurs while the Motorcycle is: (i) used for commercial hire; (ii) used in connection with conduct that could be properly charged as a felony, or involved in a speed test, contest, or driver training activity; (iii) operated by a person other than an Authorized Driver; or, (iv) operated outside the United States. The fee for Collision Damage Waiver is limited to the amount noted on the current Price List. Purchase of a CDW is optional and is not required in order to rent the motorcycle.

FOR RENTALS COMMENCING IN ILLINOIS: Any CDW purchased by you will be invalidated, and we will not waive our right to hold you financially responsible for loss of or damage to the Motorcycle if the loss or damage results from or occurs: (a) while the Motorcycle is used to carry persons or property for a charge or fee; (b) during an organized or agreed upon racing or speed contest or demonstration or pushing or pulling activity in which the rental vehicle is actively involved; (c) and that could reasonably be expected from an intentional or criminal act of the driver other than a traffic infraction; (d) any auto business operation, including but not limited to repairing, servicing, testing, washing, parking, storing, or selling of automobiles; (e) if this Agreement is based on fraudulent or material misrepresentation by the renter; (f) arising out of the use of the Motorcycle outside the continental United States or Canada; (g) while the Motorcycle is operated by a driver not permitted under the rental agreement; or (h) while the Motorcycle is operated by a driver under the influence of alcohol, other drug or drugs, intoxicating compound or compounds, or any combination thereof and convicted of violating subsection (a) of Section 11-501 of the Illinois Vehicle Code. The fee for Collision Damage Waiver is limited to the amount noted on the current Price List.

CONDITIONS OF USE AND PROHIBITED USES

Conditions of Use. During the Rental Period:

You must park the Motorcycle safely. For example, when the Motorcycle is not in use, you must lock and block the steering wheel and keep all Motorcycle documents with you.
You agree to use only fuel that meets the manufacturer’s specifications and regularly monitor oil and water levels, tire pressure, and any other basic systems of the Motorcycle.
Only the person or persons identified and accepted as Authorized Drivers by the Rental Company are permitted to drive the Motorcycle.
You agree to comply with all laws applicable to your use of the Motorcycle, including those regulating helmets, protective eye gear, lane splitting, and other rules of the road. You are responsible for knowing and understanding the laws of each jurisdiction in which you operate the Motorcycle.

Prohibited Use. The following uses of the Motorcycle or actions that you or another driver take (or fail to take) are considered “Prohibited Uses” of the Motorcycle. Prohibited Uses are material breaches of this Agreement and include the following:

se of the Motorcycle to:

Transport of passengers or cargo for hire;
Push or tow another motorcycle or any other object;
Transport cargo for any unlawful purpose;
Transport more than the maximum number of passengers specified by the manufacturer or applicable law, or to transport passengers who are riding in any position other on a seat designed for passenger use;
Transport cargo in excess of the weight/quantity/volume specified by the manufacturer;
Transport hazardous or dangerous materials;
In furtherance of any illegal purpose or under any circumstance that would constitute a felony or other violation of law (other than a minor traffic violation);
Outside of the continental United States;
On unpaved roads;
To transport an animal (other than a service animal);
When it is reasonable to know that further operation would damage the Motorcycle; and
In connection with a willful, wanton, or reckless act.

Driving the Motorcycle outside the continental United States;
Subleasing, sub-renting or disposing of, mortgaging, exercising a lien, selling, or pledging as security the Motorcycle, equipment, tools and/or accessories and any part thereof, or use with the Motorcycle in such a manner that causes damage to us.
Transferring the Motorcycle to any island without our prior written approval;
Use by any person:

Who is not an Authorized Driver;
Who does not have a valid license for operation of a motorcycle with the same rating as the Motorcycle;
Whose driver’s license is suspended;
Who is under the influence of prescription, non-prescription drugs or alcohol;
Who obtained the Motorcycle or extended the Rental Period by giving us false, fraudulent, or misleading information; and
Who is operating the Motorcycle while using a hand-held wireless communications device or other device that is capable of receiving or transmitting telephonic communications, electronic data, mail or text messages while not in hands-free mode.

ROADSIDE ASSISTANCE

Roadside assistance is available to all renters. In some cases, we may offer additional Roadside Assistance protection. If you purchase the optional Roadside Assistance protection, we (or our designee) will provide you with towing, emergency fuel delivery (up to two gallons), and jump start services without additional charge. If you do not purchase Roadside Assistance Protection, you may incur additional costs if we provide the services described above. When deciding whether to purchase Roadside Assistance Protection, you may wish to check whether you have other coverage for the services. ROADSIDE ASSISTANCE PROTECTION IS NOT INSURANCE AND IS OPTIONAL. ROADSIDE ASSISTANCE PROTECTION IS VOID IF YOU ARE IN BREACH OF THIS AGREEMENT, INCLUDING THE PROHIBITED USES IN PARAGRAPH 10.

INSURANCE; INDEMNIFICATION; HANDLING CLAIMS

Insurance. You are responsible for all damage or loss to the Motorcycle as further described in Paragraph 8. You also are responsible for all damage or loss that you cause to third parties or their property. You agree to provide automobile liability, collision and comprehensive insurance covering you, us, and the Motorcycle. We also provide an insurance policy (“Policy”) that covers automobile liability coverage for bodily injury and property damage to third parties with limits no higher than the minimum amounts stated in the financial responsibility insurance laws of the state whose laws apply to the loss. Any insurance we are required to provide is excess to any other valid and collectible insurance whether primary, secondary, excess or contingent. The Policy contains exclusions, conditions, and limitations applicable to anyone claiming coverage. To the extent permitted by law, you and we reject PIP, medical payments, no-fault, uninsured and under-insured motorist coverage. To the extent such protection is imposed by operation of law, that protection will be for the minimum limits required by applicable law. You understand that passengers are not covered for personal injury under the Policy and therefore ride at their own risk. You acknowledge that you are responsible for any injury to the passengers that you carry on the Motorcycle.
Indemnification. To the fullest extent permitted by law, you agree to indemnify us, defend us and hold us harmless from all claims, demands, actions, liability, costs and attorney fees we incur (collectively “Claims”) resulting from, or arising out of, this rental and your use of the Motorcycle, or our repossession of it, including Claims resulting from or arising out of the carrying of any passengers on the Motorcycle.
Handling Claims. You must: (i) report all damage to us and all accidents or incidents to us and the police as soon as you discover them (but no later than 24 hours after the incident) and complete our incident report form, which is included with the Motorcycle documents; (ii) provide us with a legible copy of any service of process, pleading, or notice of any kind related to an accident or other incident involving the Motorcycle; and (iii) cooperate with us, the police, and our insurance company in any subsequent investigation or legal proceedings.. Coverage under the Policy may be void if you give the Motorcycle to an unauthorized driver or otherwise materially breach this Agreement; or if you fail to cooperate in a loss investigation or to file a timely and accurate incident report. We are under no obligation to provide a replacement motorcycle to you if the rented Motorcycle is lost, damaged or stolen.

TOLLS AND VIOLATIONS

You are liable for paying charging authorities directly all tolls (“Tolls”) and parking citations, photo enforcement fees, fines for toll evasion, and other fines, fees, and penalties (each a “Violation”) assessed against you, us or the Motorcycle during this rental. If we are notified by charging authorities that we may be responsible for payment of a Violation, you agree that we may, in our sole discretion, transfer liability for any Toll or Violation assessed against the Motorcycle during the Rental Period to you personally. If liability is transferred to you, we will charge you an administrative fee of up to $35 per Toll or Violation. You authorize us to release your rental and billing information, including payment card information, to the charging authorities for processing/billing purposes. Note: Certain toll roads do not accept cash. To avoid toll violations and associated fines, fees, and taxes (and our processing fees), you must pay all tolls with a personal transponder that is accepted on the road; use only cash lanes and pay cash; plan a route to avoid tolls; or consult local authorities for other payment methods.

PERSONAL BELONGINGS

We are not responsible for loss of or damage to personal property that was left with us or carried in or on the Motorcycle. If you fail to claim property left in the Motorcycle for more than 30 days, we may dispose of that property in a manner we choose. To the extent permitted by law, You waive all claims against us, our agents and employees for loss of or damage to the personal property of you or another person, which we received, handled, or stored, or which was left or carried in or on the Motorcycle or in any service vehicle or in our offices, whether or not the loss of damage was caused by our negligence or was otherwise our responsibility. The Motorcycle may be equipped with an infotainment system that permits you to pair your own mobile devices. If you choose to do so, please note that the Motorcycle may automatically load your address book, store your incoming, outgoing, and missed telephone calls, and other information from your device. You should follow the steps displayed on the motorcycle’s system screen to delete this information and the device from the Motorcycle’s memory. We are not responsible for assuring the privacy of any such information and cannot guarantee that other persons you do not authorize will gain access to this information after you return the Motorcycle.

DISPUTE RESOLUTION; ARBITRATION

Pre-Dispute Resolution Procedure: Before asserting a claim in any proceeding (including, but not limited to, in an individual arbitration proceeding or in a small claims court proceeding), you and Rental Company agree that each shall give the other party written notice of the claim to be asserted 30 days before initiating a proceeding and make a reasonable good faith effort to resolve the claim. If you intend to assert a claim against Rental Company, you must send the written notice of the claim to Attention: HR USA – MOTORCYCLE RENTALS & TOURS, INC., 2875 East Patrick Lane Suite B - Las Vegas, Nevada, +1 702 723 9783. Rental Company intends to assert a claim against you, we will send the written notice of the claim to you at your address appearing in our records. The parties may, but are under no obligation to, engage in privileged settlement negotiations during this 30 day period. NO SETTLEMENT DEMAND OR SETTLEMENT OFFER USED IN THIS PRE-DISPUTE RESOLUTION PROCESS MAY BE USED IN ANY PROCEEDING, INCLUDING AS EVIDENCE OR AS AN ADMISSION OF ANY LIABILITY OR DAMAGES (OR LACK THEREOF). Dispute Resolution: (Not applicable if mandatory arbitration is prohibited by law). Except as otherwise provided below, in the event of a dispute that cannot be resolved informally through the pre-dispute resolution procedure, all disputes between you and Rental Company arising out of, relating to or in connection with your rental of a car from Rental Company and the Rental Agreement shall be exclusively adjudicated by binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. There is an impartial arbitrator but no judge or jury in arbitration. Both parties waive the right to jury trial. Arbitration procedures are simpler and more limited than rules applicable in court and review by a court is limited.

YOU AND RENTAL COMPANY AGREE THAT ANY SUCH ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ARBITRATION PROCEEDING. Notwithstanding any provision in the Rental Agreement to the contrary, if the class action waiver in the prior sentence is deemed invalid or unenforceable, neither you nor we are entitled to pursue dispute resolution by binding arbitration. If you are an individual (instead of, for instance, a partnership, corporation, or other form of entity or non-natural person), in the event that (1) your claim is less than $10,000, and (2) you are able to demonstrate that the costs of arbitration will be prohibitive as compared to costs of litigation, Rental Company will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive as compared to the cost of litigation. This arbitration agreement is subject to the Federal Arbitration Act. The arbitrator’s award may be entered in any court of competent jurisdiction. Notwithstanding any provision in the Rental Agreement to the contrary, the parties agree that if Rental Company seeks to delete or materially modify the agreement to arbitrate from this dispute resolution provision, any such deletion or material modification will not apply to any individual claim(s) of which you have already provided notice to Rental Company. Information on AAA, its rules and procedures, and how to file an arbitration claim can be found by contacting AAA at 800-778-7879 or on its website at http://www.adr.org.

Disputes and claims that are within the scope of a small claims court’s authority, as well as disputes and claims regarding physical bodily injury and/or damage to or loss of a Vehicle related to your Rental Company rental, are exempt from the foregoing dispute resolution provision. Notwithstanding anything to the contrary in the Commercial Rules of the AAA, the parties agree to submit any dispute regarding the determination of the scope and validity of this arbitration provision and its exclusions (arbitrability) to a court rather than to an arbitrator.

TELEMATICS NOTICE.

The Motorcycle may be equipped with global positioning satellite (GPS) technology or another telematics system, and/or an event data recorder (EDR). You acknowledge and authorize that your use of this Motorcycle may be remotely monitored by us or on behalf of us through such systems to the extent permitted by law. This remote monitoring may include collection of Motorcycle data, such as: location, odometer, oil life, fuel level, tire pressure, battery state of charge, diagnostic trouble codes, and other elements we may deem necessary. To the extent permitted by law, we may disable the Motorcycle when we deem necessary, including if you breach this Agreement. These systems may use cellular communications, and you should have no expectation of privacy related to your use of this Motorcycle. You agree to inform all drivers and passengers of the Motorcycle of the terms of this section, and that you have authorized release of information collected by GPS or other telematics system or EDR. We are not responsible for the operability of any telematics navigational or other system included with the Motorcycle. To the extent permitted by law, you agree to indemnify, defend and hold us harmless from any damage to persons or property caused by failure of the GPS or other telematics system or EDR to operate properly, or otherwise arising from the use of the GPS or other telematics system or EDR.

PERSONAL INFORMATION

Some of the uses and disclosures in Hertz Ride Privacy Policy may involve the transfer and processing of your Personal Data to and in various countries around the world, that may have different levels of privacy protection than your country of residence or interaction with Us.

E.U. – U.S. PRIVACY SHIELD FRAMEWORK: The Rental Company in the U.S. participates in the EU-U.S. Privacy Shield Framework (the "Framework"). Company's participation in the Framework applies to Personal Data received in the United States from the European Union ("EU"). The Rental Company is committed to subjecting such EU Personal Data to the Framework to the extent that the Rental Company has received it in reliance on the Framework, including its Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. To learn more about the Framework, visit the U.S. Department of Commerce's Privacy Shield List at https://www.privacyshield.gov/list.

Where the Rental Company transfers your Personal Data outside of the European Economic Area or to any other organization in the US which participates in the Framework, or to a country which is not covered by an adequacy decision from the European Commission, the Rental Company implements standard contractual clauses.

MISCELLANEOUS

No term of this Agreement can be waived or modified except by a writing that we have signed. This Agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us regarding this rental are void. A waiver by us of any breach of this Agreement is not a waiver of any additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. To the extent permitted by law: (a) you waive all recourse against us for any criminal reports or prosecutions that we take against you that arise out of your breach of this Agreement; and (b) you release us from all liability for consequential, special or punitive damages in connection with this rental or the reservation of a motorcycle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.

WARNING: Operating a motor vehicle can expose you to chemicals including engine exhaust, carbon monoxide, phthalates, and lead, which are known to the State of California to cause cancer and birth defects or other reproductive harm. To minimize exposure, avoid breathing exhaust, do not idle the engine except as necessary, and assure adequate ventilation inside the car.
